Police Check Certificate - Really need advice

Hello everybody,

I'm filling the information for application after receiving ITA now. I have a concern regarding to my situation and any your advice is very appreciated by me.

I was in Australia from Aug 14th 2016 to Feb 12th 2017. Also, I went back to my home country for about 12 days in that period (from Nov 24th 2016 to Dec 07th 2016). So when I was preparing the document, I always thought that I didnt need to get police check in Australia.

When I filled the information on CIC profile, I realized that they will ask for your police check certificate based on the personal activities we filed. Also there is just month and year in this section. So if I file from Aug to Feb they will ask me for a police certificate. If it is from Sep to Feb, I am good...

So, in my situation, do you think I have to get a police check certificate in Australia also? Is there any professional who can help me in this question?

You have to get PCC from all the countries in which you stayed for equal to more than 6 months continuously in the past 10 years.

Mention those two dates separately. But, do mention both of these two dates, seperately. That way, you are not lying nor misrepresenting yourself.

You might or might not be asked for a PCC from Australia. If they ask for one, then get one.

Thanks for your reply. I wanna emphasize that I dont lie. Or at least I didnt lie. Thats why I brought my issue here. Its not only 2 days. I left Australia to visit my home country from Nov 24th to Dec 07th 2016. Thats why in my understanding I didnt stay in Australia for enough 6months.

Just the problem is that when we fill in the information, the CIC system just asks monthly period. So in my case, which month should I file? Do I must get PCC for Australia? Then that means eventually the statement living in that country continuously for 6months or more seems not correct? I dont know.

In the first trip, you were in Australia from 14 August 2016 to 24th November 2016. So, the months would be August 2016 and November 2016. That is 4 months, you don't need a PCC for this period.

Your second trip was from December 7th 2016 to Feb 12th 2017. So, the months would be December 2016 and Feb 2017, that is 3 months, you don't need a PCC for this period.

You need to get a certificate ifor
  • every country you (or a family member) stayed in during the last 10 years for 6 months or more in a row

This is what the rule book says, however

Under Examples Section in the below link, this is what is says:

Lailah studied in Spain between 2014 and 2017, for several 4-month study periods but she did not stay there for 6 months or more in a row. The system will not ask for a police certificate, but an officer may ask for one from Spain after she submits her application. To avoid delays, Lailah could ask for a police certificate from Spain and submit it with her application.

This is what the rule book says, if I were you, I would get a PCC from Australia and submit it along with my application just to avoid unncecessary delays.

Absolutely get the PCC for Australia... I was asked for a different country for a stay of 5 months with breaks in between. Plus it is so easy to get why don't do it and be ahead of any ADR's?

Thank you so much for your sharing! I will do that. I was just thinking simply that well I didnt stay there for enough 6 months, lol.

See, you were in Australia from Aug 14th 2016 to Feb 12th 2017, right? And in between, you went to your home country for 12 days.

Just because you were not in Australia for 12 days in a way that you didn't complete 6 months in a row, might be objective for the computer but any other system with subjective reasoning (like a human) would imply that you were indeed living in Australia for a good period of time.

See, situations are not always objective, and they are always open to interpretations, I was your assessing officer, though you were not there in Australia for 12 days, I would still consider you as a resident of Australia for whole 7 months. That's subjective reasoning, which will happen to you once you submit your ITA and get your AOR.

If someone is staying in a foreign country for let's say for even more than a month or two, raises questions, like what were you doing there? Why were you staying there for such long period? What was there in the foreign country for which you had to stay there? Were you working there? If yes, was it on a valid work visa or PR? If not, how were you able support yourself. It just opens a Pandora's box.


You should get your PCC from Australia to avoid delays in your application, because you will get a request for PCC from Australia. Though, technically you did not live for Australia for 6 months, but "practically" and "socially" you did.

And also in those area they give you the choice to state the date. Just in the personal activities they just ask month to month, and that section decides if they require you need PCC or you dont. That's absolutely fine. Be open. You are not lying nor misrepresenting yourself. A lot of people, with no intention of lying, sometimes, end up misrepresenting themselves for which they get a procedural fairness letter. In your case, at the most, you'll get a letter from IRCC asking for a PCC from Australia, that's it. But, if you do get one, the request, it will invite unnecessary delays and you would get at max 60 days to submit that document, so it's better that you get a PCC from Australia and submit it along with your application to avoid any delays.
