2. Legitimately married to a Canadian. Your spouse can sponsor you.
3. Have solid job sponsorship from a company inside Canada.
4. Has the right type of skills needed in Canada.

I know your suggestion about studying in Canada would be good, I just was dreaming to settle a new life in Canada taking advantage of my current status as TFW and of the chance that my employer is giving me to hire me permanently.

Thanks for considering my English is good, I took a short course in my home country because the owner of the company where I worked almost all my life is American and I had to find a way to comunícate with him. My wife has taught me a lot too.

1. In the stream you mentioned is clearly written valid work permit, for all other employer driven streams LMIA is required (as a result of positive LMIA a work permit is issued, otherwise it would have no sence).

2. High school is education beyond basic education and this can vary and differ between standard high school diploma or trades certification (if secpndary education is finished by such certificate). The catch is such that practicaly any B level skill does require one or another. So the proof of secondary education is required.


3. Now they will be assessing him against that NOC code - 7281. here is what it is said in the NOC Description:

Employment requirements
Completion of secondary school is usually required.
Completion of a three- to four-year apprenticeship program
or
A combination of over four years of work experience in the trade and some high school, college or industry courses in bricklaying is usually required to be eligible for trade certification.
Trade certification for bricklayers is compulsory in Nova Scotia, New Brunswick and Quebec and available, but voluntary, in all other provinces and the Yukon.
Trade certification for stonemasons is available, but voluntary, in Newfoundland and Labrador.
Trade certification for restoration stone masons is available, but voluntary, in Nova Scotia.
Red Seal endorsement is also available to qualified bricklayers upon successful completion of the interprovincial Red Seal examination.



When it come to English test, I was stating as a might possibility (one of the possibile ways how to assure on the federal level, that you do know at least one of the official languages).

Who is not eligible?

The following are not eligible under the AINP Employer-Driven Stream, Skilled Worker Category:
Supervisors, foremen and tradespeople, working in a Compulsory or Optional Trade in Alberta (including Chefs, Cooks, and Line Cooks) Compulsory and Optional Trades are eligible under the Strategic Recruitment Stream, Compulsory and Optional Trades Category.


Your NOC belongs under Optional trade.

And when it come to the Compulsory and optional trades criteria :

You must have a valid Alberta Qualification Certificate in a compulsory or optional trade (PDF), or
a valid Alberta Apprenticeship and Industry Training (AIT) Recognized Trade Certificate in a compulsory or optional trade (PDF)
If you do not have an Alberta Qualification Certificate or an AIT Recognized Trade Certificate when you apply to the AINP, your application will be declined. The AINP will verify that your trade certificate is valid and qualifies.


And when it comes to language there:

You are required to meet language requirements for semi-skilled occupations.
A Canadian English Language Proficiency Index Program (CELPIP) General Test taken on or after April 1, 2014, with minimum scores of: Listening: 4
Reading: 4
Writing: 4
Speaking: 4

An International English Language Testing System (IELTS) General Test with minimum scores of:
Listening: 4.5
Reading: 3.5
Writing: 4
Speaking: 4

A Test d'Évaluation de Français (TEF) with minimum scores of: Listening: 145
Reading: 121
Writing: 181
Speaking: 181


So yes, he needs proof of education and yes he would need language test for Alberta.

if you want to immigrate to Alberta you need your trade certificat as bricklayer/stonecutter
here is the link from AIT where you will find more information about it
and you have to make a theory exam and practical exam to get you AIT-certificat

In order to get the certificate done.
Also he has almost 1 year done in Canada, that is not enough to apply for the experience based certificate exam.
He would need 4 1/2 years of proven work experience. What follows is not clear if he can or cannot use foreign work experience.

This letter is to be prepared on company or business letterhead, completed and signed by the owner or a senior official of an Alberta-based employer and provided to the individual named in the letter, or submitted directly to the nearest Apprenticeship and Industry Training office.


So that would lead him back to school (the other way to get it if it is not possible to use work experiece from abroad).

As for the language i got confused with the operator part.

for bricklayer/stonecutter NOC 7281 he don't need a english test because it is a NOC B
and not a semi-skilled occupation

I was afraid that I needed something like that, I just was kind of confused if it was optional or a must, that's why I tried to find someone who had gone through this pathway before, I think now we all got to the same conclusion I need to study or to be certified in my occupation in order to apply under AINP. I truly appreciate all the time and research you did for me. Thanks and good luck in all you do.
