hello, as I've read we can apply for the outland sponsorship even if my husband is still here in canada. His work permit expired and we are applying to restore his status as a visitor. Initially we planned to do an inland spousal application, but when i checked the timeline it takes 14 months now for initial assessment, and when i checked the timeline from our country of origin the total processing is 15 months. so we were thinking to do the outland application coz it makes more sense. so i should put canada as his current country of residence but his status is visitor (if ever he gets approve of the visit visa)? would that be ok? or will there be any problems when the officer assess our application forms? thanks

no problem at all! As long as his status is legal here (as long as you change his status from worker to visitor before it expires) he has absolutely no problem. He can say he is in Canada and give his address here.

oh ok.. will there be a problem in the application if he's not currently working right now? he just had his work permit expired and now he's on a 90 day restoration period but we've already submitted the application to restore as a visitor online. thanks for the quick reply..

nope, they don't care if he is employed or not.

thanks much kayaker for the input

Hi may I know what application kit do u use for applying outland even if staying in canada? And which VO should I send it? Philippines or Ottawa? Thanks!

There is no different kit if you are applying outland but staying in Canada . Your application will go to Mississauga first to get Sponsor approval then get transferred to the country you have residence in .. E.G. Philippines. .

Is that really TRUE??? I never knew that we can apply outland if both of us are within Canada. If thats the case, I would consider to withdraw my inland application to outland with take shorter time.

yes, it is absolutely true that a person can apply OUTLAND even if currently in Canada as a visitor, student or worker. Applying outland has nothing to do with the location of the applicant. it has everything to do with where the applicant is from and where the application will be processed.

So does outland application also have stage 1 approval that can offer a OWP for my sponsorer if we got approved in 60days (according to current processing time)

No. OWP is only available with an Inland application.
