dear friends ,

in my case i have different case to others. i have visa till march 2016 but plan is to marry land together. now what are the options available to me..??

1) can i add her in my file now??

2) As i have got visa, can i land before her medical and ppr?? or we will have to wait till her file is cleared?

3) in case if i postpone marriage and plan to sponsor her, is it mendatory to be there in canada at least for one year to show one year income in sponser assessment form??

4) can i do short landing and get PR card and marry her and sponser her staying in india??

5) what are the other best options?

friends pls pls share your feedback on this.. i am in great dilemma whether to do court marriage to add her or postpone and sponsor her at a later stage.. I dont have hurry to go to canada at all..
 
You should post your question to the Skilled Worker section of the forum. This section of the forum is for Canadian citizens and permanent residents who are sponsoring family members for PR. You will get more replies in the Skilled Worker section.

1) You can only add her to your file once you are married.
2) If you get married and add her to your file now, your visa will no longer be valid. So no - you will not be able to land before her medical and PPR - you will have to wait until CIC processes her file and issues new visas to both you and her.
3) No - there is no income requirement or residency requirement. You can sponsor her right away.
4) No - you must be living in Canada when you sponsor her. You cannot do this from India
5) We can't decide for you - this is a decision you have to make.

You cannot land as you will be asked to submit your passport and COPR and will be issued new COPR with your wife as dependent. If you land anyhow without doing so you will loose the chance of sponsoring her and she will be excluded from the family class.

You do not need to be in canada for 1 year to sponsor. You can sponsor immediately provided you should be in canada during the process

5) what are the other best options? you have both option get married inform CHC, submit your passport and copr wait for 6 months to 1 year to get new copr along with your spouse copr. or land in canada as single get PR go to india, get married come back to canada, sponsor her and wait in canada till she comes to canada.

But i had question for income and stay in Canada because in sponser assessment form they have asked for last year assessment of tax.. so i had that question.

Are you 100% sure that they won't ask for 1 year full tax and stay..
 
best to go ahead and land now, then return to india get married and then sponsor her.

remember, if u marry now, wait for her visa.....note that if her medical does not clear, your whole pr case may be rejected in case her medicals don;t clear (fail, too much demand, etc)......

but when u sponsor her AFTER, she will not need to worry about medical concerns as she will then be exempt from those strict guidelines.
