Please share info on TRP for non-PR child and visitor visa

Dear experts,

Please help me in below issue:

My family members (my wife, two daugther and myself) are PR holders. We have received our PRs in 2010, stayed in Canada and left to our home country due to our family situation. We have third daughter born in our home country. We applied for TRV through embassy in Moscow for my non-PR child and got rejected. Few days ago we arrived in Canada leaving our non-PR baby in my home country with my Mom. We had some troubles with the immigration at the airport while entering Canada for not meeting residency obligations, but fortunately have not been reported. Now, the first thing I must do is to start TRP process for my non-PR child as both my wife and myself are really having hard time missing our little one.

While talking to the visa officer at the airport she said that we can apply for TRP for our non-PR child. But the problem is that it is very risky for me or my wife to go back home for a week or less to bring my child once we have TRP approved. Because while entering next time in Pearson, visa officer will indeed report me as there are records in my file made in their system.

I have couple questions to respected experts and the people who had such experience:

1. Will TRP process is handled by the embassy or immigration in Canada?

2. As I am at risk of being reported if I go out of Canada once we got TRP my father-in-law is ready to travel to Canada to bring my daughter. What is the chance that he gets Canadian visa?

The TRP would likely be handled by the local embassy wherever the child is located, however, you do realize they ARE immigration Canada, right? Her TRP isn't likely to be valid for the next 730 days (minus the few weeks you have been here already) in order for you to apply for her sponsorship. If you apply for her sponsorship before your 730 days are complete then you will put yourself right back where you were when you came back to Canada, only this time, you don't get a pass by some nice officer. The file will be placed directly on the desk of an immigration officer by you yourself.

I can not, nor can anyone else here answer the question about whether or not your your father in law will be able to get a travel visa to bring the child. That would be up to him to file for the visa and see if he is accepted or rejected. None of us here actually work for CIC, as far as I know, so we know the rules just like you do, and we can only guess at the outcome, as you can also do.

I feel sorry for your situation and I know it must be hard to have left one of your family members behind, but in reading your previous posts, you really can't blame anyone but yourself for this situation, as sad as it is.
