Hello everyone,

I'm in a unique situation and haven't found anything similar in my research. I'm a Canadian citizen by birth, married in 2010 to my spouse who resides in an African country. Our marriage and ceremony were held there, and though we initially applied for sponsorship, family problems led us to withdraw our application and separate without legally filing for divorce or separation.

Over the years, we both declared ourselves as single, dated other people, and had different relationships. Recently,
we reconnected, and after several visits to their country, we've decided to live together in Canada. I intend to sponsor my spouse to come and live with me.

Knowing That’s marriage certificate, still valid in the country where the marriage occurred, would be considered for applying under the Spouse Class by immigration authorities in Canada.
Or as we get back together after a Long separation we should Do another Marriage and another certificate?
Any advice or insights on this matter would be greatly appreciated.
Thanks everyone

In your situation, where you and your spouse separated without legally filing for divorce and are now reuniting with the intention to live together in Canada, there are several key points to consider for the spouse sponsorship process:

1. **Validity of the Original Marriage Certificate**: The original marriage certificate, if still valid in the country where the marriage occurred, is generally acceptable for Canadian immigration purposes. You would not necessarily need to remarry or obtain a new marriage certificate. The Canadian immigration authorities require a marriage certificate as part of the documentation to prove the relationship [oai_citation:1,Assessing the relationship between spouses or common-law partners - Canada.ca](https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/non-economic-classes/family-class-determining-spouse/assessing-relationship.html).

2. **Proof of a Genuine Relationship**: Immigration, Refugees and Citizenship Canada (IRCC) officers must be satisfied that your relationship is genuine. A long separation where both parties declared themselves as single and dated others might raise questions about the genuineness of the relationship. You will need to provide substantial evidence that you have reconnected and that your relationship is genuine and not entered into primarily for immigration purposes. This can include a completed Relationship Information and Sponsorship Evaluation questionnaire, proof of joint ownership or rental of property, joint utility accounts, insurance policies showing the same address, etc. [oai_citation:2,Assessing the relationship between spouses or common-law partners - Canada.ca](https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/non-economic-classes/family-class-determining-spouse/assessing-relationship.html) [oai_citation:3,Assessing the relationship between spouses or common-law partners - Canada.ca](https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/non-economic-classes/family-class-determining-spouse/assessing-relationship.html).

3. **Concerns About Misrepresentation or Fraud**: It's important to be aware that if the IRCC suspects that the relationship was dissolved and then resumed for the purpose of acquiring immigration status, it could lead to the refusal of the sponsorship. Misrepresentation or fraudulent marriages can lead to revocation of permanent resident status and even deportation [oai_citation:4,Spousal sponsorship separation: How does it effect my sponsorship?](https://immigrating-to-canada.com/sponsor/spousal-sponsorship/spousal-sponsorship-separation/).

4. **Notification of Changes**: If your circumstances have changed significantly since your initial application (such as a long separation where you both declared yourselves as single), it is advisable to be transparent about these changes in your new application. Failing to disclose significant changes might be seen as misrepresentation [oai_citation:5,Spousal sponsorship separation: How does it effect my sponsorship?](https://immigrating-to-canada.com/sponsor/spousal-sponsorship/spousal-sponsorship-separation/).

Given these considerations, while you don't necessarily need to have a new marriage ceremony, you do need to be prepared to provide comprehensive evidence of the genuineness of your rekindled relationship. It’s recommended to consult with an immigration lawyer or a consultant for personalized guidance, especially in complex cases like yours. Remember that every case is unique, and the final decision rests with the immigration authorities based on the specifics of your situation.

How much time have you physically spent together since you got back together? Is living otgether for some period first feasible?
