If your wife had lived in Canada three years in the past 4 years before applying for citizenship, you can actually wait until she became a Canadian citizen and then live with you in UK. She can sponsor you for immigration afterwards.

Trying to be with my Wife said:
I think i have a case of appeal, as i have refrences, and have attended drink driving course and am back on the road since last year. My lawyer advises me it is worth putting a appeal in but to collate all information which will show what kind of character i am.
I'm not sure where you get that idea. It sounds like the refusal was valid under applicable law, and you haven't mentioned that there is a child that would be adversely affected by this decision (what's frequently called "humanitarian and compassionate grounds"). What basis do you think you have for an appeal?

Unless there's something you are not saying, you are just not eligible to apply. It doesn't matter if you deem yourself rehabilitated. The board will look at it, see that you don't have a formal pardon, and declare that you "are not a member of the family class" and it's "case closed". It would be over in no time.

I wish I could tell you otherwise, but that's the truth. Drunk driving in particular is a very serious criminal conviction in Canada, much more serious than it is in some other countries.

Your wife is just going to have to go to the U.K. if you want to be with her. Check the rules carefully to see how long she is allowed to be out of Canada and keep her PR. Also, as a PR, she must be living in Canada at the time she sponsors you.

If you're inadmissible due to criminality, you almost certainly aren't going to get a TRV if you can't get PR.

The OP doesn't need to get a visitor visa because he is a UK citizen. He should be holding a British passport, being one of the visa-exempted countries.

They will probably let you in, Trying, but you won't have any status other than a visitor. You won't be able to work legally or have healthcare unless you buy travel insurance. You won't have any right to stay more than 6 months.

What the VO has done considering your record cannot be termed as wrong from any angle

IN the Criminal record that you have had

Is there any offence that is still sub Judice If there is none please provide them a character certificate from you local Police Station
( PCC ) that will help you in a appeal

If your offence is still in the court of law or you have been sentenced in an offence at any level your re appeal will be of no consequence.

any any case you need a Lawyer not a consultant.

Best of luck

I wondered while you wait for your rehabitation status and your wife wait for her citizenship, can you apply a visa to the states (such as detroit) so that your wife and you can be "together"? You can read this thread for reference:

http://www.canadavisa.com/canada-immigration-discussion-board/-t50805.0.html

As long as your wife is sleeping in Canada, she is residing in Canada and would qualify to apply for citizenship

The OP does need a temporary resident permit if he's otherwise criminally inadmissible, and may not be able to enter the U.S., either.

The OP needs a Temporary Resident Permit to enter Canada because of the drunk driving conviction. The link he posted does state he can get a TRP, but it also says he needs 'urgent and compelling reasons' to come to Canada to get the permit. Just wanting to be with your wife will not be considered an urgent and compelling reason, especially when she could just go to the UK to see him.

Several have advised that you do not.
It is obvious you are hell bent on an appeal and thus I think it no longer matter what we say because at the end of the day, you have already made up your mind.
Please note, Lawyers/Consultants all want your money, they really don't care if you have a case or not.

Would you trust a lawyer, just got a consultancy adv me me fees upto $4000 and said i have a good chance in getting my sponser approved....Hmm....
Exactly what I said before.. it would take over a year to get into court for the appeal anyway, and everyone here has said that there is basically no chance that you will be admitted. If you want to throw 4000+ dollars away, go ahead and appeal. You really should just wait the two years and apply again.
