Hi
I am Refugee claimant in Canada I live in Ottawa and I have full time job here , recently I got married from PR holder she is student here and she has just 18 years old , I still waiting my hearing they sent to me letter said its coming a few months my question can my wife sponsor me if she does not has job ,she live with me and I pay rent and all thing is that work for sponsorship application ?.

She certainly can sponsor you, but you guys will have to explain how you will support yourselves. Also, being so young and still a student, it would probably help to have some letter from her family showing that they support your relationship and help prove it is genuine.

It is probably better to do this sooner than later because if you are denied refugee status and en get married and apply for sponsorship after receiving a denial, they will really question whether your relationship is genuine or not. I don't know for sure, but I think it would be better to do it now, just in case the refugee pr doesn't go through.

She can sponsor you, but because you're a refugee claimant, you will have a difficult road to be approved as a permanent resident. She's only 18, how old are you? How long have you guys dated before marriage? What country are you applying as a refugee from? etc. It's not impossible to be approved if the rest of your relationship background seems good.

I am from Syria I have 26 years old and I work full time with 13 per hour , i can pay all thing for our life , and I register our marriage I asked lawyer he said she cant sponsor you because she doesn't has job I don't know what I can do ?

the sponsor does not need to have a job to sponsor their spouse. there are many sponsors who are approved who are not employed. the attorney you talked to is absolutely wrong. i do not recommend paying this attorney since he sounds like he doesn't know this.

your greatest issue will be the fact you have applied for refugee status, and you have a significant age difference.

She doesn't need a job to sponsor you, she just has to explain how you guys will support each other.

Lawyer is wrong, she can sponsor you, she does not need a job. She just cannot be on social assistance (welfare), and she has to demonstrate how she can take care of you, or how both of you can take care of yourselves without going on welfare. You should definitely hire another lawyer, as this one clearly doesn't know what they're talking about.

Being from Syria, I think you will have a pretty good chance of being approved as a refugee.

$13/hr isn't a lot of money, it would be a good idea for either her to find a job, or have a statement from her parents saying they will take care of both you guys, otherwise CIC might want to know how can someone who makes $13/hr can take care of two people and pay rent.

what don't you understand? the fact you applied for refugee status will be a red flag and the fact you have an 8 year age difference will probably also be a red flad, especially since she is only 18 years old. these "red flags" (concerns of the immigration officer looking at your file) will most likely guarantee you will have an interview, which will delay the application approval. from CIC's point of view, it *could* look like you only married your wife so you can remain in canada and gain pr status. that is a big no-no and subject to a rejection.

How long did you date before getting married?
And what kind of wedding did you have, big or small? And did lots of family/friends attend the wedding?

if she was on welfare within the last 12 months, then it may be difficult for her to be approved as a sponsor. maybe THAT is why your lawyer suggested she can't sponsor you. she needs to show proof she is currently off the provencial welfare list by specifically requesting a letter from the welfare agency that specifically states she is no longer receiving welfare benefits.

Thanks but I got married after I applied for refugee status and I will don't use this thing if I go to interview <<

Yes, but how will you take care of her also if you're just barely getting by taking care of yourself? She doesn't need a job, it would help a lot if she did, but you have to show how you guys will support each other. Seeing as how she went on welfare before, CIC wants to be sure it doesn't happen again.

so? you still are waiting for refugee status. it can look to immigration that you married her in case that application was rejected, so you can get approved as a pr through her. still a red flag.
