Please help - Spousal Sponsorship Form IMM 1344A

Hi again, this is my second set of queries for our application, I’ll copy this next paragraph from my first post :

First a Very brief relationship history, I'm a British citizen from England who married my Canadian wife last year. I came over to live with her late last year & we are preparing our application under the "Spouse or Common-Law Partner In Canada Class", form IMM 5289E, with her obviously sponsoring me as her spouse.

So here we are, knee deep in papers, trying to understand & complete our application.

This query is on form IMM 1344A :-

Question 1 on page 1 says “If you are found ineligible to sponsor, indicate whether you want” & then gives you 2 options, basically either to withdraw proceed with the application. It seems that if you withdraw then the application is not processed & you are refunded all but $75 of your fees, & if you proceed the application is processed & you are not refunded anything. What I’m wondering is are there any more details or consequences to this choice that I may not be aware of, & whether anyone could offer me any further explanation or insight. It just feels to me that there is more to this than meets the eye.

You want to tick A and get your money back If you choose to proceed, due to ineligibility to sponsor your application will be refused, period - but for some very special cases this is unimportant, because in those very special cases applicants had no hopes of their application being accepted anyway; instead, they plan to appeal and use the benefit of humanitarian and compassionate (H&C) grounds discretion that is available to those judging the appeal process, and which sometimes (in the aforementioned very special cases) makes getting PR possible for normally inadmissible candidates.

Appeals, however, are lengthy, expensive and complicated. Ideally, if your sponsorship application does get refused, you want a refund and an explanation so you could quickly fix the problem and simply reapply.

But if you put get your money back doesn't that seem like you are only interested in the money and not the importance of your partner coming to canada with you. Wouldn't it be grounds for a non geniun relationship since your not willing to ride it out for the long run and loose out on a couple 1000. All in the name of love... or am i just thinking to much into it??

I actually had the same question and started to read through the threads to see if someone had touched this topic.

No, because if your sponsorship application gets refused the rest of the application goes right down the drain with it. There is no way PR application could possibly be accepted if sponsor was found ineligible, don't think too much into that question

malirca may be on to something. just for the record, i put proceed with the application. if you think you are ineligible to sponsor, you should not be submitting your application in the first place and waste your time. instead you should correct the situation first asap and then submit your application.

Fleo is correct, you should just ask for the refund. It's not a trick question to test whether your relationship is genuine. If you are refused as a sponsor, then the rest of the application is invalid, as you are applying as a "sponsored spouse". Most people who would be refused as a sponsor would find out why, correct the issue and re-apply with the refunded money.

They are not going to look at that question and say to themselves : Oh this relationship must be genuine since they dont want their money back... so lets give them the PR visa... IO is gonna think, what a fool, we will collect another 1040$ when they re-apply, oh well, and still stamped refuse.

What you think of your eligibility to sponsor doesn't really matter much to CIC - you either can sponsor or you can't. If you can't and know that, then yes, you can fix the problem before you send in the application - but if you can't and don't know it, then it's in your best interest to find it out as soon as possible so you can fix the problem and re-submit. Proceeding with the application will do nothing but waste your time and money, since it won't be accepted no matter how genuine you are.
