hii friends !!
im a student tunisien
i did a interview and i didnt underestand the agent nd she didnt underestand me too
so we get the refuse based on age ?(11years), language and culture and the agent feel that our marriage is not geniune cos we married in her first trip here ...we will do an adr whenever they decide the date
so please tell me what i can do to be with my wife cos i cant live without her
she did a 5 trips here nd we have a 300 pictures nd 3 dvd of party of weeding / 3000 history of msn / phone bils for me nd for here more then 100 lettres by post office
so please help me

why didnt u get a translator?
also did u order your CAIPS before the interview? these usually help applicants see why they were called for an interview which gives them time to prepare

between now and your ADR collect your proof as you will need it to show your relationship is real also if you havent done so order your CAIPS

i really loves here plus i have the eneneering civil so i dnt need to go to canada to have a job
but she cant comes here cos she have a baby nd her ex men dnt wanna to give her a passport to take her here

Have your wife look over the CAIPS notes and the refusal letter. These will explain why your application was refused. Then you and your wife must gather evidence to show that the visa officer's reasons were wrong. The evidence of her trips to see you and of your communication are all good evidence that your marriage is genuine.
Your wife must also convince the judge at the appeal hearing that the differences between you two are not important. Is your wife 11 years older than you? If so, you must state that you have discussed this age difference, and that it does not matter to either of you.
One thing that will help is showing that you have a relationship with her child (if that is possible) and that you are interested in the child, who is after all your stepchild. So you should know a lot about the child. You should also know a lot about your wife's life in Canada.
For an ADR hearing, they may not call you. But if it goes to a full appeal, it will be better if you testify. If the visa officer could not understand you, the judge won't be able to either. If you use a translator, the judge will wonder how you and your wife communicate. So if you do use a translator, you must stress it is just because of the stress of the hearing, and that you can speak English and do with your wife. If your wife knows your native language, include proof of this in the appeal documents. If you decide to not use a translator, I suggest you start taking English lessons if possible. You may never have to testify if the ADR heaing goes well, but it is better to start preparing now just in case it does not go well.

If you don't have time to study English, well, it's not necessary - just something that might help. The important thing is that your wife stresses that you and she have no trouble communicating, even if the VO had difficulty understanding you. My husband and I had the same problem at the appeal hearing - I could understand him fine, but the judge certainly could not.

Basically for the ADR hearing your wife needs to look at all the reasons your PR visa application was refused, and then gather evidence to prove that each of these reasons is not relevant.
A big age difference can be countered by testimony that neither of you cares about the age difference; by all evidence that shows your relationship is genuine, including affidavits from people who know you two and who state that they believe your relationship is genuine; evidence that in your family and/or her family marrying an older woman is normal (even though it may not be in your culture) - if that is the case, of course.
A difference in language such that the VO believes you two cannot communicate well enough can be countered by evidence that your wife is learning your language; by evidence that you do know English well, you just have an accent; and by evidence from your wife that she can understand you well, even if others can't.
For the cultural difference, you can show that the two of you are learning about each other's cultures.

In any case, the most important thing is to show your relationship is genuine. So the same types of evidence you used to prove that in your application should be used in the ADR.

just i dnt trust my self when i talk with atheres (lol)
nd we have more then 7000 pages of history of msn in english we talk good nd we underestand each ather so much
nd i will be fine in english when i will be with my wife cos there i should speak just english
cos her the arabic is the first language nd the french is the secend

About half of appeals are allowed, so you have a good chance. And when they let you have an ADR, it means they already think your case has at least some merit - otherwise they would make you go straight to a full appeal hearing.
Lots of people have been accepted with a big age difference as well.
