got ya! Yours is more complicated coz you have children. If I were in your situation, I would seek help from a lawyer or from experts on immigration, just to be sure. Just my opinion.

Hi Veronica,
Did u got ur PR?

I would like to do a notary for divorce. I am in Canada as a immigrant and i applied for permanent residence
I got married in April 2013 and in May i came back to Canada and I updated my status in my file as a married and i included her as a my spouse but things didn't worked well between us and we mutually decided to get divorce. so i exclude her from my PR file and gave reason that we are going to start divorce process.

Now, CIC wants supporting documents which confirms our divorce or present situation. So we would like to do a notary which shows that we both are separated. My spouse is in India and we married in India too. Now due to rule we have to wait one year before we admit our divorce case in Court. We are going to put case in July and we will get divorce document from court in December which is too late to send to CIC

So, I would like to know can i send notary document which shows mutually agreement of divorce? Is it legal and acceptable in Canada?

I just read your situation. I think they will accept that, because I also submitted a notarized affidavit as proof of separation abd they approved my application.

Sent you a pm. I'm not really familiar with legalities and stuff but all the things I said were just based on my experience.

Thanks a lot Veronica.
I was really tensed because CIC gave me only 60 days to answer.
I have notarized copy ready with our both sign and picture as mutual agreement on divorce. Also CIC asked me to fill form and asked me to do a agreement that i will never ever able to sponser her in future which i will sign and send whit this Notarized Affidavit.

Thanks again

No problem. I filled up and signed that form/declaration too. You're all good to go. :)
