Please help me - Applying for divorce on mutual consent

we didn't apply for marriage certificate that time. now she will not help me at all. i am just wondering are they going to completely close CEC. there is no other way to apply for PR?.

if she get full custody of my child, how can he be my dependent. i can not sponsor him in future as he can not leave her mother. even though i ask my wife for any help, she may not do as we are separated.

Regardless of custody, he is your dependent child and you will still be legally obligated to him.

If the mother gains sole custody and refuses to let the child have a medical or give you his documents, you will need the court papers showing you have no custody and an affidavit stating that you understand your child will be forever excluded from the Family Class and that you will never be able to sponsor him.

CIC accepts the affidavit for children due to the legal restraints of custody agreements. There is no such legal constraint preventing you from divorcing your spouse.

Put your marital status as Legally Separated and include proof that you have filed for divorce. Once the divorce is granted, send CIC a copy of the certificate.

I applied as legally separated too since me and husband were not living together for 4years and we had problems later on. I did not include him in my application, so he don't have to do medicals even though he wouldn't accompany me in canada. When CIC asked for proof of separation, I just submitted an affidavit stating what happened in our marriage and have it notarized, and also **spam** requested for a declaration form from CIC, declaring that he is not a family member and that I will not sponsor him in the near future. So far, haven't heard from CIC yet if they need more addtl document.

it's a declaration to remove him/her as part of your family member and that you will not sponsor him/her even in the future. My agency requested that form from cpp ottawa, also I submitted a notarized affidavit explaining what happened in the marriage.

My agency is visa solution. I applied when I was in canada and now im in the Philippines right now. have u done your medicals already?

okay pala.. hehe! oo tapos na medicals namin e, galing din ako sa canada 5 yrs din ako dun kaso umuwi ako d2 ko nlng pinasa application ko.. veronica kailangan ko tlga ng mga info tungkol sa status ko, nagrequest kc CEM ng docu galing court regarding legally separation.. baka pwedeng sabihin mo sa akin mga documents na kailangan ipasa? salamat ha?

I have sent mails to couple of immigration consultants and got the reply from one guy. He said that he will deal with my case and asked me to pay 4k. I have to pay 2k now and 2k later. Probably he will exclude wife and kid from my application. I mentioned to him that i dont have any documents of them includes marriage certificate or diverse certificate, dob, passport copies. Only the thing i can do is creating affadavit saying as i will not sponser them in future. I am not sure if they accept. He didnt tell me how he is going to handle.

wow! That's a lot of money. Btw, did u try calling that agency I told u? Maybe they are cheaper?
