I don't believe that YOU are intending to cheat anyone. The rules exist because there are other people that do try.

However, the fact remains that you must make the application that includes ALL of you and it will fail until your husband is recovered enough to pass the medical. I hope he recovers soon and you are able to start the process again.
Until he is well, you should not waste any fees submitting any new applications.

Good luck.

I am sorry you guys are getting me wrong here, my intention is not to take advantage of or cheat Canadian medical system, I already have paid processing fee for my husband and which is not refundable now and I am ready to pay again in family class just to get more time so that my husband's health get better. I already said he needs long treatment that is about 6 months or so. If I get visa now and then apply again for my husband in family class that would easily consume more than a years time and I am sure by that time my husband will be treated and must be in better health. So at that time he could get medical clearance.
None of us think you are trying to cheat the system. We know you are just exploring all of the possible options so that you can still migrate with your family.

Unfortunately the rules are black and white and you don't have any options. Your husband MUST pass the medical now for you to get the visa. If he fails the medical your visa will be denied too. Again, it does't matter if he is accompanying you to Canada or not. He must still pass the medical in order for you to get your visa.
