Hi.

I submitted my sponsorship application for my parents and 2 brothers in Aug 2009, and on mid September 2013, my parents and youngest brother received their permanent resident visas.

One of my brothers didn't get the visa because when immigration asked us to resubmit and update the forms in 2012, we decided and sent a letter that declare him as non-accompanying member.

My brother actually completed all the requirements and passed the clearances and medical examinations. Is it still possible to change his status from non-accompanying to accompanying now after the visa released/application completed? If not, could my father sponsor him without age requirement? He's 22 years old now and have a full-time job, if my father will sponsor him once settled in Canada, is his age still considered locked-in since he was on the original sponsorship application (18 years that time) and with non-accompanying status?

Is there someone out there have the same situation? Please advise.

Unfortunately it's too late.

His age was only locked in while he was an accompanying dependent on the original application. His age is no longer locked in since the original application has been closed/completed. And now he's too old to be sponsored in a new application.

He will have to qualify to immigrate independently.

Hi Scylla, I'm curious about this one. I thought CIC was not changing the dependent age until Jan. 2014. Couldn't the OP's father still sponsor? Or no because he is a new PR? Not worth a call to CIC or a lawyer?

I should have been clearer in my response (and yes - the rules aren't changing until January but that's immaterial in this case). The brother now has a full time job. By virtue of that fact alone - he is no longer a dependent of the father and therefore doesn't qualify for sponsorship.

So if the brother was laid off or lost his job or went back to full time studies could he then be sponsored? Again, just wondering.........thanks.

No. The requirements states that a child over the age of 22 must have "been continuously enrolled as a full-time student and depended substantially on the financial support of a parent since before the age of 22".
