Dear Shigri,

Hello Mayank:

I got the email from CIO but unfortunately my application has been turned down :(

This is what they say

"This refers to your application for permanent residence in Canada as a Federal Skilled Worker. I have now completed the assessment of your application and have determined that you are not eligible for processing in this category for the following reason(s):

The Minister of Citizenship and Immigration issued Instructions which were published in the Canada Gazette on June 26, 2010. Only applicants who meet the criteria specified in these Ministerial Instructions are eligible to be processed in the Federal Skilled Worker class.

You have indicated that you have work experience in an occupation with the following NOC (National Occupational Classification) code: 3131 - Pharmacist. Although this NOC code corresponds to the occupations specified in the Instructions identified by the Minister, you have not provided sufficient evidence that you performed the actions described in the lead statement for the occupation or that you performed a substantial number of the main duties of the occupation as set out in the occupational description of the NOC, including all of the essential duties.

After taking into consideration the work experience supporting documentation on file, I am not satisfied that you have performed the actions described in the lead statement for the occupation or that you performed a substantial number of the main duties of the position as described in NOC. As such, I am not satisfied that you are a 3131 - Pharmacist.

Since you did not provide evidence that you have an Arranged Employment Offer, you do not meet the requirements of the Ministerial Instructions and your application is not eligible for processing.

Note: Any reference to work experience in a NOC code other than those identified by the Minister of Citizenship and Immigration and published in the Canada Gazette on June 26, 2010 is not assessed for eligibility under Ministerial Instructions.

Your application, therefore, does not meet the requirements of the Ministerial Instructions."

Actually my experience is of Pharmaceutical sales. In the description of Pharmacist : 3131, under the heading of Industrial Pharmacist they have mentioned the following line

"Promote pharmaceutical products to health professionals"

I thought this makes me qualify for this category.

Just wanted to ask you that is there any way i can talk to these guys about this description. Atleast other people could benefit from it.

Anyways thnx for you support. It was a short period here in this forum but it really is like a family out here helping one other. I wish our whole world turns in such a family. All the best and gud luck everybody.

Regards

Amir

Dear Shukat57,

Congrats for your PER in just 34 DAYS :o :o.

This shows that CIO is having less file intake day by day . Hope this kind of speed can be seen at VO level.

Mayank

Hi shigri,

I am sorry to learn of your NER. Unfortunately to be eligible your work experience must match the lead statement and a substantial number of the duties to qualify, so only 1 of the duties would not be sufficient. There is some ambiguity since CIC do not define what a "substantial" amount means - they leave this to the discretion of the immigration officer. But most people agree they like to see at least 50% of the duties, so if there are 8 lines listed you generally need at least 4. Depending on the strength of your application you might get away with 3 or so - but if you only match 1 line of the description then regrettably there is no way they will agree you are eligible.

Ah well, maybe see if the list changes on 1st July 2011 which is only a few month away?

All the best,
Wayne.

dear mayank.
many thanks for your appreciated help and support.
i called the bank as u told me to do to know when my BD has been cashed by CIO but they told me that they can not know when but usually any BD from my bank to Canada needs 4 working days to be cashed.
as i told you before, i made the BD at 2nd of march, i sent my application to CIO at 4th of march and application received by CIO at 10th of march.
so according to my bank, BD has been cashed at 9th of march i.e. 1 day before my application being received. is this applicable? do CIO cashes BDs before they receive the application? by the way the money amount of BD was deducted from my account on the same day i made the BD ( 2nd of march) and still deducted to this date. please advise me as i don't know whether my application being accepted and processed or not and i don't know if the one who served me in the bank when i asked about the BD is professional or not!
thanks again 4 u and everyone in this family-like blog ;) :)

My Agent in Canada sent my application to the CIC on 2/12/2010 under the NOC 3131, but he didn't receive anything till now,
So are they going to check my application , or they still open the pending applications before Dec 2010,
and if they will not accept my application, did they send it back to my agent and when ???

When I submitted 1st time my application was retuned to me after 1month 8days as there was some mistakes like my spouse didnt signed the form,so if ur applaction isnt accepeted it is returned to ur agent within 2month if not thn u may b safe

Dear Hope,

This is general timeline as it all depends on VO as well as application documents.

CIO-ER to RBVO ---> 20 to 30 days.

RBVO to In process ---> 15-30 days. Here is the main checking is done by VO. if they have any query then e-cas status will stick to RBVO.

Hope this help.

MAyank

Dear MAHERZAD,

I think you got confused. Let me help you.

As you made BD on 02 march & application was received by CIO on 10th march. So there is no way that BD can get encashed before your application reached to CIO.

Only advise to you that just wait for 10-15 days max to know the status of your application.

As CIO is already issuing PER in 30-35 days max. so just wait for 10 -15 april. If you are lucky then do not forget to check your email with PER news.

Good luck.

Regards,
Mayank

dear mayank.
again thanks for your nice reply.
i just reviewed the old posts and i noted that someone said that his application has been returned back to him from CIO because his wife didn't sign the application!
i signed my wife's application and she didn't sign any papers. am i was correct or not as i applied by my self and there is nothing saying in application guide that my wife has to sign any application?
another thing i noticed that you asked another applicant whether he wrote his IELTS results in 0008 generic or not.
i didn't write my IELTS results in any of application papers as they didn't ask for. what i did is submitting my original IELTS results dated 4th of Oct 2010. am i right or not?
thanks alot for your appreciated support. i'll keep you and everyone here updated about my application status once i have any update.
