PGWP - Failed Courses

Hey everyone, Need some advice for my brother. He had completed a 1 year program in 2020 and started his second one year program in 2021. He was supposed to graduate after completing Spring 2021 but unfortunately he failed some courses in both first and last semesters which he had to repeat in Fall 2021 and Winter 2022.

Here is summary:

Winter 2020: Full time
Fall 2020: Full time (graduated from 1st program)


Winter 2021: Full time (first semester)
Spring 2021: Full time (supposed to be his last semester)
Fall 2021: Part time (started as full time then dropped one course after the mid terms to maintain his academic standing and became part time. It was too late to pick another course because everything was closed.)
Winter 2022: Full time (graduated finally)

Should he attach a LOE along with his PGWP application? Any one had seen similar cases?

Also the first program may not count towards the PGWP because it must be completed within two years. He started Winter 2020 (assume January) and completed the second program Winter 2022 (assume April).

Thank you. I do not think that would be the case. I had a friend who completed two 1 year certificate programs in similar timeline as my brother. He got 3 year work permit. We will see what happens.

Then he got lucky because it states, “The student completed more than one program from an eligible DLI within 2 years.” So your brother has two issues to overcome - not being eligible because he was part-time and only being able to count the second program because he didn’t complete the two programs within two years.

Oh I see. In that we will add this in LOE as well. His first program was delayed because of COVID. Else he would have graduated spring of 2020 and started his second program Fall 2020. Thank you for pointing this out.

Graduating in spring 2020 has nothing to do with it or delay because of COVID. He started Winter 2020 and completed the first program on time. To combine the programs, he must complete both of them within 2 years. Because he took so long wth the second program, his first program is no longer eligible.

We are going to take a chance and apply with both his programs. Totally upon visa officer now if they will consider his first program or not.

Hey All, I am coming here to update the outcome. My brother got 3 year PGWP approved this week. We attached a very simple 1 page LOE along with his application. Thank you all.
