Hi, I hope anybody can help with this. So this is the detailed situation:

I did a post-graduate study for 1 year in Canada. Got my PGWP on February 26th, 2014. Started working for my company on March 24th, 2014. They gave me a permanent offer. NOC category A (Project Manager). I married my wife in January 2014 and she came in May to study English. My work permit expires on Feb 25th, 2015 and her visa expires on April 16th, 2015. I applied for the AINP in June, I received my file number on september, but the webpage says the process will last 18-24 months. Company won't do LMO citing many reasons (mostly because of paperwork, most companies find this annoying). But they wan't to keep me. I will qualify for CEC on March 2015, one month after my work permit expires. Finally, my wife will probably extend her english course until may, and will apply for college in order to start in September.

So the question is, what are my options for extending my work permit? I need to get that extra month in order to qualify for CEC (plus I need to keep working to keep my AINP application valid). here are some toughs, please comment about it:

1) There's no LMO option, so the first option I think is to get my wife permit extend (get the acceptance letter from college ASAP) and for me to apply as an accompanying spouse for an open work permit, and continue working for my company. Is this ok?

2) Another option (don't know if possible) is to apply as an accompanying spouse for the extra two months of difference that are between my permit and her permit (mine expiring in feb, hers in April). That way I would also meet the one year requirement and apply for CEC, then she would be my accompanying spouse. Don't know if you can apply for such a short time. (We're both here in Calgary, me working and she studying).

3) Apply for a work permit extension just before my permit expires, with the AINP file number, my permanent job offer, and a letter of my employer citing that they will support my CEC application the moment I get to the full year. (Again, LMO is not an option, they will not go that way).

Please let me know what is my best option. I believe the study one makes sense, but I need to be certain about it. I have a great job, only issue they don't deal with LMO's (I wasn't supossed to need one to start, everything went bad with the AINP delays).

1. She has to be attending a recognized school before you can apply for a spousal open work permit. English language classes don't count.

2. Nope, won't work as she is attending language classes, therefor you aren't eligible for SOWP.

3. No, you need the ANIP approval letter, file number is not sufficient to apply for a work permit.

Hi PMM, thanks for your answer. If you can, please clarify these two things for me then:

1) She will be extending her Visa with a LOA from a college. So the moment she gets her Visa extended I would apply for my open work permit. If she applies right now, and she gets it already, will my open work permit only be valid from next September on?

2) If her study permit expires in April and her acceptance letter is for September can she still apply for an extension? Does she has to leave the country for four months? Or once she gets it she can stay here anyway?

3) What would be my other option if not? I only need one more month to get the full year and qualify for CEC. (Visa expires in Feb, get to the full year in March). There has to be one way !!! (that is not LMO)

Have you found a solution to your problem???

I am in a very similar situation (my PGWP expires Sept 2015 and I applied for AINP in July 2014).
My employer also doesnt want to do LMIA...

Dear All,

My name is Arju Vohra and recently finished my studies. My study permit expires on 31 july 2018 and my husband open work permit expires on 31 July 2018. As I posses A category job, I applied my PGWP on 6 jjne 2018 and also applied my husband spousal open work permit.
My husband has applied for AINP in jan 2018 and my only concern is that his work permit expires by July and i do not see any chances of getting spousal work permit before july. If he do not get spousal work permit before july and acquire restoration period than our AINP will be cancelled automatically as we will have to maintain our work permit status.
Secondly, we were thinking to go to Border for our both work permit but I find it lots of risk.
Please provide a better suggestion.
