Permanent Residence Application - not approved

I just got a letter from the Cdn embassy in LA informing me that they have not approved me for Permanent Residence. Couple of reasons were stated. One was that they were not satified that my wife in China is a bonafide spouse. Second is that they were not impressed that I was not able to attend a interview in LA under their request. I missed the interview because I didn't bother to apply for a US Visa because my brother in law just got refused back in Feb 09' and he was in the exact same situation as me. He went to the US consulate in Vancouver for a interview for his US Visa and they automatically refused him due to the fact that he was a temporary foreign worker. Didn't even look at his supporting documents.

Is there some kind of appeal process out there ?

This story is incomplete. Where are you located right now. If you are in the US, why didn't you simply attend their interview. Your brother went out of the US to renew his status and got rejected. If I am right, You are still in the US, all you needed to have done is go to LA for the interview. Your not showing up was not their fault but yours and suggests two things. First, either you are no more in the US or second, the information you provided was false. Based on these the IO would be perfectly in order to reject your application. It will be tough defending why you did not go to the LA interview, but there is an appeal process depending on how long it was they rejected the application. But my sense is you do not have a grounds for a successful challenge. I might be wrong, but I would hate for you to spend your money on a lawyer for the same free advice

You had your chance, as other have been warned in the past, if you don't attend the interview, the decision will be made with the information on file, and as you found out, that usually results in a refusal. You only appeal is for leave to the Federal Court, you have 60 days to appeal and there must have been an error in law for you to succeed.
