my Application for PR was denied, it was under the Post graduate work stream.
the reason they gave was:
"I am not satisfied that you meet the Canadian educational credentials as you have not provided evidence of having completed a program of study or training for two years before obtaining a Canadian educational credential.

I have also assessed wither applicant you meet the temporary foreign worker requirements. According to your employment letter, you worked as a graphic designer; however there is no description of the work you performed. In the absence of a description of duties, I am not satisfied you performed the duties"


i have all the documents to prove my having completed a program of study or training for two years before obtaining a Canadian educational credential and a new letter from my employee showing the duties i performed as related to my NOC, for the required minimum of 24 months.

Since the decision has been made will i have to re-apply and start the process over? can i submit the missing documents after the decision has been made, and they will revise it?or is there an option to go through lawyers and try to appeal the decision?

What are my options? and what is the best one?

Your only option is to reapply.

You won't need require the educational component anymore only 12 months of FT (or PT equiv.) work experience.

Anyone thinking of reapplying without the required ref. letter should think again.

I agree with JSM.

I have, painstakingly, been working on my reference letter to make it as perfect as possible, because remember it is a PASS/FAIL situation and you ONLY GET ONE CHANCE, if your letter fails to establish you credibility for the CEC program, then this results in a denial.

Please re-apply.
 
I do not understand. Did you provide them with your official transcript from the university?And if yes how could they doubt? Maybe the school is wrong (without accreditation)?

It's not really clear from the original post whether that was in the original submission or something they have only obtained now (like the detailed work reference letter). My guess is the latter.
 
Your case get me nervous. I didn't list details of my duties on my background letter and reference letter. I just said I'm managing teams and responsible for all IT related system and problems. I've been in TFW for about 16 month under LMO with the same NOC, will CIC see my previous LMO and NOC? Also on my work permit paper, it has the similar occupation. My work contract (offer letter) did mention my work title as NOC title as well.
Should I be worried?
 
It's not really clear from the original post whether that was in the original submission or something they have only obtained now (like the detailed work reference letter). My guess is the latter.

According to the first post there were to reasons to reject: 1. Unsufficient evidence of completed education.2. No job duties described in the reference letter.

You need to have all duties listed...if you already have your AOR, better to send updated employment letter with a covering letter..but please do not deviate too much from original letter....just add duties. There were cases earlier where revised letter caused problems.

In agreement with all of the above comments...this is a PASS/FAIL system, wherein the VO determines your eligibility, based on experience. If there is no supporting evidence or sufficient information (which is a letter that does not provide details), its likely they would assume that your duties do not match. Remember, the burden of proof remains with the principal applicant. Its on you to convince them that your experience is skilled...to which end, the reference letter is key, since it provides substantive background.

Thanks for the suggestion, I'll do that when I receive AOR.
