Hi All,

I remember in this forum I have read a topic 2 or 3 weeks ago, someone's wife was overstayed in US for 4 years an Indian National and they have submitted the same passport while gaining the PR visa for Canada in US (Buffalo or some where in US). But they have granted the visa for the that family without a single query.

Work permit, Residency, Nationality Or Assylum?
and above all did you married in Uk or in your home country ?

and As Joy said, it is very intersting that you got PCC in UK without a status in UK.....I am afraid that you have got PCC for this period from your Home country?

I said i am not judging this lady because I am not an immigration officer. I never referred to you as judging anyone. We are only giving our opinions.
I also read it in the application form, specifcally, schedule 1 background declaration form, question 6.
They ask for your status in the country that you claim you are in. There is an option to select 'Non status' so I was asking ivyie which one dis she chose for her husband. It will also be interesting to know where the husband performed his medicals.

The Applicant, myself, I am on a 2 year working visa in the UK and we got married in my home country.
I have never been this worried about something else like this. All I need is advise and some hope. Should I withdraw this case? or just send all our documents including his blank passport to them?

This is a very difficult one.
Your best bet is to speak to an immigration lawyer or if you cannot afford it you can immediately write a cover letter to the high commission explaining your situation without hiding anything this time around. Once they know your husband's position, they are the only people that can make a decision whether to tell you to go ahead and submit your passports for PR visas or otherwise. Just so for your conscience to be clear, not because of today but TOMORROW and they are the only one that can also decide whether not to charge you for MISREPRESENTATION.
This is my honest advise to you.

Thank you for your advise Vamsi001. I was thinking doing this too. I forgot to mention, he had tried to apply for a dependant visa here but got refused on grounds that they can not find any record of his entry here and they are not convinced about his relation to his cousin (whom he is applying this dependant visa on) Would this be of any help if I attache all the documents he used to apply for this?

If you have all the documents that back him up that he has been trying to be a legal resident in the u.k, you can attach them but this does not guarantee anything really as you should have mentioned it to them originally that he is an illegal resident in the u.k.
They might consider your case if he has tried to be dependant but was refused in the u.k but remember, if they are the one to discover that he is an illegal reisdent in u.k and there has been an error due to a concealment of a material fact by an applicant, they don't take it lightly. Write them a letter to explain the whole situation, the reason(s) why you didn't inform them before, etc. They will contact you the next thing you need to do, whether you should come for interview with your husband or whether to go ahead and submit your passports or whether they will refuse you. I am not an immigration officer, I can't tell you exactly what they will say but by so doing, you will be able to sleep with all your eyes closed. Remember the truth shall alsways prevail so even if you are refused this time around, you can re-apply without concealing any information from them.
