hi,mine expire by March end and now they requested for remedical after sitting on my passports for 3 months so they can always surprise you with such nonsensical stuff

I had sent my passports in October when my son's passport still had more than 6 months of validity. I had raised an urgent request as my Driver's license was expiring and they have now looked into my request. Now they are saying my son's passport has a validity of less than 6 months and they cannot process my application until I provide a renewed passport.
For that, I would need to retrieve all our passports back to get his passport renewed as he is a minor. Now the Indian embassy in the USA needs my valid H4 approval status for his passport renewal and I haven't got my H4 receipt notice yet. I am not even sure if I can renew his passport with just the receipt notice. I will have to go to India to do it as they immediately need a renewed passport but even that takes a lot of time.
I told all my problems and emailed telling them that I had sent the passports at the correct time, but now more than 3 months have passed since I sent the passport and hence the problem. I even asked if there is any option to keep my application valid if I cannot get the passport within 30 days. But they are saying you have to give us the new passport and there is nothing else that they can do. This is so aggravating! How can they just keep the passports for all this time and now refuse to honor that I had sent on time. How will I do international travel with a kid in these times and get the passport?
Does talking to an immigration attorney help? Any suggestions on what I can do?
I reached USCIS, but they are running late and even though I applied for H4 in December, they haven't even sent me a receipt notice yet. I had called them today, but they said a receipt number has not been generated for me yet! So without that there is no way I can apply for his passport as I have nothing to show for my legal status! Now Canada also has a time limit to submit his passport. Not sure what to do! I have to get all our passports back now They could have asked for it now instead of keeping it for more than 3 months. AFAIK Indian embassy should be able to work on receipt notice, check with USCIS if they can assist, as h4 approval shoudl be pretty quick

I don't want to make things seem even worse for you, but my family hasn't yet received H4 biometrics notices from USCIS, although they have applied in April 2020, so USCIS is the least helpful entity here. In any case - good luck! Keep reaching out to the embassy and bombarding IRCC with your requests. try india embassy, may be your spouse's h1 might or if you have i-140. that should be enough for indian embassy to see as proof. i guess the best bet is to present all the docs to indian embassy so they understand the situation
