Parent Sponsorship 2017

Hi,

FIRST OPTION:
I had filed my dad's sponsorship (widowed) in 2014. I was hopeful that the application would go through.
Stage 1:
we passed the eligibility.
Stage 2:
However, because I was previously adopted by my Auntie legally, and I was told that he no longer is a member of your "family class." Why wouldn't "adoption" be on the list on the CIC website of "who cannot sponsor a family member?!" I received the latest letter from CIC-Manila Philippines about this in March 2015. Could they not have screened and rejected the application in January 2014? As of yet, they still haven't given me a denial letter if they already know I can't move forward with this application. Can I cancel at any point or wait for that letter? Why waste people's time and money if CIC immigration cannot be specific?!

has anyone experienced this? (Btw..he is here as a tourist visa in Canada and I stated he is my biological father in the application form and it was approved,so it's confusing.)

SECOND OPTION:
My brother, who is eligible to apply in terms of family relationship may run into a snag in the LICO requirement. If he were to sponsor in 2017, LICO for 4 people is:

2015 $58,768
2014 $57,125
2013 $56,280

My brother falls $272 short for 2013 minimum requirement. Should he still proceed to put application through?
Is this amount including LICO and 30% or still need to add 30% to this income amount?
As well should I cancel the previous 2014 application before we submit for 2017?

Please help!

Withdraw the 2014 application - there is no chance it's going to be approved since your father is no longer classified as a parent for immigration purposes due to the adoption.

The minimum income requirement is just that. If your brother is even a dollar short any of the three years, he won't be approved. He needs to wait until he fully meets LICO for all three years.

I am married! My wife is the only child or daughter for her mother. We both are Canadian. How her mother is old, she could stay alone; we decided to sponsor her to Canada. My wife is a medical Doctor from Europe, it is not easy to get the license to work as a medical Doctor in Canada, and she decided to go to University again to become a Register Nurse. We sponsor her mother to come to Canada as Family sponsorship. Her mother got a Visa of 10 years (we call it Super Visa). Even to take the plane to come to Canada, we bought a ticket for one of our friends to bring her to Canada. Her mother's body is half paralysed. There is nobody to help my wife's mother over there (In Europe).
When my wife's mother came to Canada, we decided to apply for PR for her. How my wife has to go to University, I am the only person who is working to support the whole family. We filled all application documents for PR and sent them to the government on January 2 / 2015. When we applied for PR for my mother-in-law, I was the main sponsor for my mother-in-law. I paid everything; I put all my pay slip. Financially, my family is over the amount they are asking to sponsor a family member. I was the primary sponsor for my mother-in-law, but they returned us all documents saying that I can not be a sponsor for my mother-in-law. They asked my wife to be a primary sponsor for her mother. We re-applied again and sent them all required documents they asked us to provide (all financial statements and support documents, plus all divorced documents of my mother-in-law in Europe) plus I was a co-signer, I supported my wife's application with my strong financial position. Two days ago, my wife got a letter from the government saying that: pursuant to regulation 133(1)(j)(i), you do not meet the minimum necessary income requirement. I was also a co-signer for my wife’s application. They consider for the second time only my wife incomes, why they don't want to consider the family income? They consider only my wife income! We are legally married and we are living together and we have one daughter together!
What is our next step to help my mother-in-law to get the PR? Because my mother-in-law is very sick and she can not travel!

I would guess adoption isn't on the list because they expect people in such a situation to understand the basic legalities of adoption. When you were adopted, your biological parents severed all legal ties to you and the people who adopted you legally became your parents.

As scylla said above, there is no leeway on meeting LICO. He needs to wait until he qualifies. I assume your brother was not adopted and therefore the legal parent-child relationship still exists.

I assume the new app was in January 2016, so did your family Canadian income meet LICO for 4 people (around $56,000) in 2012, 2013 and 2014?

If so, then it sounds like CIC made a mistake. I would contact them immediately and stress the fact you're a co-signer and to include your income as well.

Hopefully your mother's medical condition doesn't also become a block to sponsoring due to excessive demand.

A final option if PR app fails, is a H&C application based on the fact there is nobody in her home country to take care of her.

Based on her medical condition, she has no chance of being approved for PR. Addressing the income issues will be the easy part. She's not going to pass the medical. Agreed with the advice above that H&C is her only option.

My son still is on his 3rd year on April 2017. If I were to file my application for PR on January 2017, he will still be 3 months short of 3 years. Does he have to complete and submit a LICO in the last 3 years for us to apply under PR with him as sponsor? Thanks

Does your son meet the LICO for 2013, 2014 and 2015? If not, he doesn't qualify to sponsor you in 2017.
