OWP with PR

Hello everyone! I am just looking for advice. I am sponsoring my American husband through the family class sponsorship. We submitted his PR along with an OWP December 19, 2018. We are still waiting to an AOR. His visitor status is up February 28, 2019. I know he has implied status while we wait for the OWP approval, but we were curious if it would be a good and safe idea to apply for a visitors extension while we wait for the approval. We have no reason to believe his OWP would be denied, but is it better to be safe and sorry in this case? Thank you!

sometimes AOR for spousal sponsorship takes around 3 months.

i would apply for visitor visa extension to remain in status......in case for whatever reason the application is returned and needs re-submitted.......note: spousal sponsorship will be processed and may be approved regardless of applicant status........OWP will not be approved if the applicant is out-of-status.

That’s where I’m a little confused. We were under the impression that he has implied status while we wait for the approval of the OWP. Even if we don’t get the approval before his vistor status is up. Is this incorrect?

AOR is what confirms that your application package has been checked to be complete and the required documents have been received.....so not until you receive AOR the implied status is not guaranteed......if for whatever reason your application is returned and needs to re-submit when the applicant is out-of-status, the OWP will not be approved and if the OWP is not approved the applicant has no implied status......so its advisable to apply for visitor visa extension just to be safe until you receive AOR and the OWP grants implied status

assuming your application is sent back in March and the applicant is out-of-status.....you may need to apply to restore status before re-submitting sponsorship + OWP......you are better submitting application for visitor visa extension.......
