Since he still has status until midnight tonight.

can we apply online to extend? what if they reject the extension?
do i use visitor visa extension or visitor visa inside canada application?

there's also a questionnaire to determine eligibility ... do we choose Visit as our reason, since he's in the system as a visitor?

You use the "application to change conditions or extend your stay as a visitor" and apply online ( it's too late to apply by paper). I'd link it but I'm on mobile. You can Google it though.

Yes, choose visiting as the reason. Include proof of the PR application.

So that didn't work - the form would not Validate and kept giving us an error due to the fact that the visa expiration date wasn't greater than todays date.

We are going to call tomorrow and see what our options are. This system is absolutely brutal. Should've done outland.

Had we known we were able to do Outland and he can stay with me and not work, we wouldve jumped on that immediately.
also regretting not getting a lawyer.

CIC needs to take accountability for this error in processing. We should be able to send in the 100 dollars after the fact through the CIC online payment.

Needless to say, we are officially upset. Shared some tears and have given up on the Canadian government.

We have so many things planned for this year, based on that permit.

feeling defeated.

I've often wondered if it really was possible to apply for an extension on the same day that status expires. Maybe it's not possible after all.

At this point, you're only real option is going to be applying for ROS.

Since it will take some time to get an answer, and then another ~4 months after that to get the OWP, you might want to seriously consider withdrawing the Inland application and submitting an Outland application now.

Don't let this defeat you, because that's the LAST thing that you need. This `journey' is filled with excitement and angst, so best not add a feeling of defeat to the mix.

Gotta agree with Ponga, if i were in your shoes I would just be looking at withdrawing and applying outland ASAP. SA is relatively quick at the moment and someone can correct me if I'm wrong but German applications are processed through the Vienna office which I think is pretty quick. Although I think there would be a good chance it went to Ottawa if he was still here in Canada with you which is also a quick office.

Strange. When I went through the questionnaire, it stated something like "Your status expires today, you must submit your app today or you will lose your status." Wonder why it would say that when the form won't validate.

You can also consider heading to the border tomorrow and flagpoling to get a visitor record. Until the OWP is returned, he actually still has valid Implied Status and doesn't qualify to apply for Restoration. He can explain to CBSA that he is trying to make sure that he stays in status while in Canada.

Re: OWP PILOT PROGRAM SPOUSAL GERMAN HUSBAND CANADIAN WIFE inland [CIC update]

Thanks everyone for your responses.

We spoke to CIC this morning - and the woman Elizabeth told us the following:

1. Since we paid our PR fees in FULL - they *MIGHT* be able to take the missing $100 work permit holder fee from our PR fees. It apparently depends on the officer.
2. If they don't, we should hear back of a decision by end of March, based on the fact we submitted our PR and OWP under pilot on November 27th.
and then we'll have to make a plan.

The agent stated that if it comes down to it we could:

a. submit Restoration of status and OWP together with the appropriate fees
b. withdraw and resubmit as Outland - though, i'm not sure if everyones aware - the Outland process has completely changed ... they no longer send forms to your HOME country, they send the forms to the closest processing centre with the shortest wait. [which is why the wait times for outland jumped to 17months]

This has been the most trying and frustrating experience the Canadian Government has ever put me through. I thought OHIP renewal lines were bad, this is even WORSE.

We even went through the forms that we had submitted and saved - and the only fee stated was the $155 on the paper forms. They have since been updated to show BOTH fees.

UGH :-\ :-\ :-\ :-\ :-\ :-\ :-\ :-\ :-\ :-\ :-\

It hasn't jumped to 17 months. Previously it had the individual visa offices average time it takes to complete 80% of applications, now its just the 80% average across all VO's. Like I said your application could go to Ottawa (which would be a good thing) but I'm skeptical that they are going to be sending applications to VO's that the applicant has zero ties too. Yet to see a case of that on here.

Take anything you hear from the call centre with a grain of salt. Call 3 times and you'll get 3 answers. There have been many people in your position and not once have we seen them take the missing $100 out of the other fees, so that is not likely to happen.

He still has valid status, so you should really consider a border run to make sure he stays in status instead of waiting to lose status and having to restore.

Just seems so shady!!! What if he gets denied at the border? Then we're really screwed.
I live in Ottawa and the border isn't far. But I am afraid they'll just NOT give him that visa.

Little chance of that. He has a PR app in process and is trying to follow the law to stay in status, which is what CBSA likes to see. If you guys go together and explain the situation, you should have no issues. Even if CBSA only grants him a short visitor record, that once again secures his status and he can then apply to CIC to extend his stay again.

Re: OWP PILOT PROGRAM SPOUSAL GERMAN HUSB, CAN WIFE - MISSING FEE UPDATE

so -

Timeline -
OWP and PR submitted under 2015 Pilot program. received by Mississauga Nov 24 2015.

our 4 months wait time expired March 24.

PREVIOUS SITUATION - realized missed a fee for OWP (MAKE SURE YOU ALL PAY $255) OWP HOLDER FEE AND WORK PERMIT FEE 155 // So we came to the forum to see what our options are. (SOME OF THE THREADS ON HERE STATE ONLY PAY 155 BUT THAT ONLY APPLIES TO LIVE IN CAREGIVERS, SO BE CAREFUL ABOUT WHAT YOU READ!!! )

Steps taken:
1. contacted IRCC - we were told that the application would be declined due to missing fee. But also of a chance that they would take the missing portion from our fully paid PR fees.
2. Husband was going to be out of status if declined - among a lot of other stressful complications
3. Husband would have had to submit OWP AND RESTORATION and he wouldve had to wait another 4 months. (ps. yes you CAN submit simultaneously a lot of the people who comment on here are INCORRECT SO DON'T TRUST EVERYTHING YOU READ FROM EVERYONE ON HERE)

------------> i am Canadian, born and raised - we contacted my local Member of Parliament here in Ottawa. [GO LIBERALS]. They spoke to IRCC for us and we had a response within 3 business days. Our MP also fought our case and since my husbands work permit application was *COMPLETE* -- they allowed us to fax in the missing fee of $100 for the holders fee - and now we are just waiting for the permit !!!! Looks like it'll be approved any day now!

THANK GODDDDDDDDD
