OWP for Student’s Spouse

Hello everyone..
knowing that my husband got his letter of approval to study in Canada, we can apply for my OWP. We are both in Canada right now, I hold a visitor visa and he is currently holding a TWP. I have some questions and I hope someone can help me:

1) Can I apply from within Canada or do I need to go back to my home country?

2) I have been here in Canada since last October, but always on regular status (as I left the Canada for other international trips and came back). My status is now valid until Nov/2014. Again, I never overstayed. My first intention when coming was visiting my brother (who is a citizen) and traveling around, but we felt in love with the country and decided to stay longer. Can the immigration officer consider the fact that I changed my mind as misrepresentation?

3) For OWP, do I have to show ties to my home country (that being Brazil) even if our intention is to stay permanently (eventually apply for PR)?

you can apply online withing canada

inside canada - rules are different, no question of misrepresentation here..

Just another question, should we apply together? I mean send mine docs for OWP and his for STUDY PERMIT together in one application? If yes, is it possible to do this joint application online?

I have this question because on his work permit it says that he has to submit any future queries to Vergreville, so I am not sure if we can apply online.

Np, yes you can apply together and probably online too, but you better verify from the below link.

Vergreville as far as i remember processes work permits, but you intend to apply for study permit for him. So probably that won't be the case.

Lastly, keep in mind that when the principal applicant is a tfw, he has a confirmed job and hence SOWP / trv does not require proof of funds. But when you apply for principal applicant as a student, you need funds for his fee, cost of living as well as for you as a requirement.

Another thing: As of June 1st, all students enrolled in full-time studies in legal institutions (as per cic website) are eligible to work off-campus right away, so no more 6 months waiting. My question is: on the form (5709), should we say that he also wants to apply for a open work permit for him or it is already implied that my husband can work just by having the study permit ? (20 hours/week)

Sorry about the 1000 questions.. my husband also have a future employment arrangement for when he is studying for those 20 hours/week allowance! Would a letter of employment (including rates, position description, conditions) be helpful as an additional financial support proof?

Last thing: when we apply for my OWP, should I apply for an extension of my visitor status as well (just in case the processing time is longer than my status)? Or am I already on implied status when applying for the owp?

I know the change in 6 months waiting. But i am not sure of the details. However, as far as i know it applies to every student, so it should be implicit and not your own choice to apply for open work permit along. Though, i would say choose the option to apply along and see if that adds any thing to total fee. If it doesn't probably that is what you should choose. However, this is just logical speculation and you should verify this further.

Emm letter of employment might be good to add, but i don't think it would value much as a financial support. Because the employer is not offering you a job on some LMO that CIC can track, it can very well be finished any day or not even commence. So i don't think they would value it much. But if i were in your shoes, i would probably attach that because it is still a positive element on file. Just make absolutely certain that the job terms are fully compliant with being a student in terms of number of hours etc.

I don't think the wp vs visitor visa processing time differ much when you apply inside Canada. Besides i know that if you are already on a work permit and you applied for extension before its expiry (i think its more like some x days before expiry) you are on implied status. So logically the same should apply to visit - work status, with the difference of course that you cannot work until your wp is approved.

If you have already been in Canada together on some legal status and even married here - No, not needed.

we have been here back in 2010 and 2013 for tourism purposes .. is that enough?
