OWP and Implied Status

I've submitted a new application for PR and OWP (inland, obviously). I'll be on implied status with my current OWP as of Friday. If, for some reason, my application is returned to me, I would immediately lose status, correct? Would I be able to submit whatever paperwork was missing and restore my status as a worker, or would I need to become a visitor and remain stuck on visitor status for the following 17 months?

I'm concerned simply because my not working would place my husband and I into a very poor financial situation.

Note: I have an OWP from a previous application for PR I'd submitted in 2013. Due to some missing paperwork and poor correspondence from the CIC, my application was refused.

Yes - if the application is returned for some reason, then you would be out of status and would have to stop working immediately.

You would only be able to restore your status back to worker at that point with an approved LMIA and full time job offer. So you would apply to restore your status to visitor and then resubmit the inland application with the OWP. If all goes well the second time around, then the OWP should be granted around four months after the second application is recieved. However you obviously would not be able to work between the time your inland application is returned and the OWP is approved. That could be four months - or it might be longer with a restoration involved.

When does your current OWP expire?

If your application is returned, before your current OWP expires, you can simply re-submit.



But...if your 2013 PR application has been refused, wouldn't that also have made your current OWP void as well, since it would have been issued based on the PR application?

After my refusal, I received a letter that stated that based on my OWP I was authorized to remain in Canada until its date of expiry. I also called to comfirm this because I also wondered if the refusal would void my OWP. Apparently not.

My current OWP expires Feb. 5, 2016 (Friday). My documents were received by the CIC on Oct. 19, 2015.

I was very thorough when preparing my applications, so I don't anticipate that it will be returned. I'm extremely paranoid, though.

That's good for you, but...it seems odd.

If the OWP was issued since you would have qualified because of the Inland sponsorship, which was denied...why would CIC allow you to then remain in Canada for the duration of the OWP?

Anyway, hopefully it's a moot point.


Oh...and you did pay the full amount for the OWP ($255), right?

As an aside, and if it matters, I did not submit my Medical or FBI check with this application. They should, however, have both on file from my last application l. I realize that I will need to resubmit both, though.

When I called the CIC today, they advised me that they haven't even opened my application yet.

Yes, I paid the full amount. I've called the CIC so many times and crossed the border a few times, and my OWP has never been questioned. Do they ever void permits based on application refusals?

Having said that, I'm glad it hasn't. Just another example of CIC's `mysteries'.

We had received initial sponsorship approval, so I never thought about it. The CIC also confirmed in my application's refusal email that I was authorized to remain in Canada until the permit expired. I really hope they would have communicated with me if I was supposed to leave the country.
