Quick question guys!

What are usually the reasons for instant denial when you're applying outland?
I would guess medical reasons, am I right?

Cause if they think your relationship is fake, then they'd call you to an interview instead of denying, or no?

I think criminal inadmissibility is one too. I believe when it comes to the relationship, they will always do an interview before a denial.

You could get a denial without an interview for misrepresentation - also if the sponsor doesn't qualify to sponsor.

There's not really an "instant" denial; it will still take a lot of months for the app to be reviewed and then denied :).

Main reason is that CIC determines the relationship isn't genuine. They do call interviews first to clear up any doubts about the relationship. But if you have a look at the appeals thread, quite a lot of them did have interviews and the officer didn't believe them and denied the visa.

Being denied for a medical reason is incredibly rare, as the excessive demand rule is not applied for spousal sponsorship. I believe they can only deny on medical grounds if the applicant has a highly contagious serious disease that would be a danger to the public. So it's rare :)

As someone else said, criminal inadmissibility as well.

If the sponsor cannot prove intent to return to Canada, is on welfare or is still subject to a previous sponsorship undertaking, then the app will be refused at stage 1.

As far as I know there is nothing medically that will cause a spouse to be denied. Unless they have a communicable disease such as TB. Even then they are requested to do follow Dr treatment and will eventually be allow to enter. There must be another reason such a above mentioned criminality.

They may also deny an application early if the visa officer determines the principal applicant does not qualify as a member of the family class (e.g. marriage not legally recognized, married to someone else and not common law, etc.). I was reading about this situation on CanLii but I can't remember if this type of refusal happens before or after an interview.

Yeah, I didn't think of that one. I guess whether the refusal comes before or after the interview would depend on the circumstances. If one spouse was previously married and they don't provide a divorce certificate when requested by CIC, then there would prob be no interview, just a denial.

My question was regarding the step 2 actually. I've read some people saying that they had it denied without an interview and I was kind of shocked.
I thought that an interview was always made in these cases.

The only reasons I can think of for denying an app without an interview are criminal inadmissibility and misrepresentation. Those 2 would be automatic denials, and misrepresentation can lead to a temporary ban from Canada as well.

When it comes to doubting the relationship, I do think they pretty much always offer an interview. If the VO denies a couple and the couple appeals, the lack of an interview probably wouldn't look good for CIC. But if the VO decides beyond all shadow of a doubt (in their mind) from the proof submitted in the app and their investigations that there is no way the relationship is genuine, then I suppose they don't really have to have an interview.
