Outland application but in Canada

Hello all

Thanks for taking the time to read.

We are applying for the spousal visa and have had my medical and received the pre-services letter, so hopefully not too much longer to go. However my wife (who is Canadian and in Canada) has a longer term illness and is becoming more ill and I really want to get over there. I can work at my current job remotely, so could easily stay there for a few months, however i'm not sure regarding the application. When they ask for biometrics etc, if i have completed and outland application would they expect this to be completed in my home country (UK)?

Or could i conceivably move over there now and complete that stuff over there?

Any thoughts would be appreciated.

You can do the biometrics anywhere in the world, by all means go and join your spouse .

I moved to Canada in the middle of my Outland application. After I got to Canada, I received AOR, biometrics, medical,,,
I was able to have done biometrics in Canada. So you don’t need to worry about it!

I think the only issue you have is that you are not eligible to work unless you have at least a work permit. It doesnt matter you are working remotely, you would be entitled to pay taxes in Canada... So I would avoid all that in any paper or conversation...

I think I accidentally reported or deleted my own post so apologies if this posts twice...

We did this (PA entering Canada while PR app in progress) two weeks ago. In terms of processing the app, you just let them know you're here in Canada *visiting* your spouse and update your address with IRCC.

One huge point though is you're not *moving* to Canada yet, just visiting. CBSA can deny you entry if they think you won't comply with the terms of entering as a visitor. We were very careful to never use moving in reference to me on any documentation etc. Told the officer that I was visiting my husband and planning to leave on XYZ date etc. We had a return ticket booked, proof of ties to the US, and more just in case. As it happened that was all not needed at the border but better to be prepared. If you search dual intent in this forum you should find more threads about that. (Of course in some ways it's a bit of a show for CBSA, because you can apply to extend your visitor visa once you're here and stay until your PR comes through, assuming the extension is approved and it's very likely to be approved

And sorry to hear about your wife's illness - that must be hugely stressful in an already stress filled immigration situation.

When requested a PPR, did you do it while in Canada? Or did you have to return to the the US at any point in the last half of your application?

Sorry, but I'm not American. I moved to Canada this January as a visitor with my Canadian husband.
I received PPR last week, but I've already told IRCC I'm already in Canada, then they designed for virtual landing (like inland applicant). I'm waiting for contact from local CIC office now. (And my timeline is in signature)

Yes i agree re the taxes etc, i wouldn't be moving, only an extended visit on a tourist visa for like 3 months so working is allowed on that. I guess it was more a question of if my visa gets approved in that time or i get a request for biometrics etc, would I be able to do it in Canada and then effectively finish off my visa application there and stay and then pop back to the UK to clear up my things and take the rest of my stuff over.

Yes you can do biometric, medical etc in Canada. Best of luck!
