Option C printout

Hi

I am a few weeks off submitting my papers. My partner is Canadian and sponsoring me. He still needs to get his option C printout but hasn't done his taxes yet for this year, just has t got round to it. Does he need to get those done before we get the option C or can we just get it from last year? Would they accept this? I only have 2 months left to submit my papers so we don't have much time to sort it out. Any help would be much appreciated. Thanks

He needs to file his taxes so he gets the correct option C print out for this year.

he definitely needs to do his taxes in order to receive his option c for the most recent year. Just an FYI - The Option C will not be available immediately after filing. It can take up to 4 weeks for the Option C to be ready after filing taxes. This is because it takes time for CRA to finalize and accept the taxes officially. (our application was delayed about 5 weeks because of this).

Whether or not CIC will accept 2012's option c at this point is anyone's guess. Since technically you are past the "filing date" for 2013, they *may* ask for an updated form. You can of course try sending the 2012 one, and just be prepared to produce the newer one if/when it's requested. That way you can at least submit the application, and get it in before your deadline.

If I recall from the document checklist if you dont have the most recent Option C printout for the last tax year you have to supply pay slips for the prior 12 months. Maybe someone else will know exactly!?

yes, this is true. if an option c is not available, an explanation and 12 months paystubs are required. However, the OP HAS an option C form, it's just not from the most recent tax year, and i doubt "not filing taxes" is a good enough explanation to be exempt from this requirement. Even if this was supplied, they still may request a recent Option C to confirm no social welfare has been used - especially if the sponsor is living and working in canada. Generally, it is my understanding that rule is used by people who do not live/work in canada. These people don't need to file canadian taxes and obviously can't draw on canadian welfare when they are outside the country, so it's not necessary to provide that information.

Yeah fair point rhcohen they would probably question why someone hasnt filed for the previous year.

Do you think my whole application could get rejected because of this? Or they will just request the most recent Option C when they see it?

there's no real consistency, so it's hard to determine. for the most part, if 1 form is missing, or they need updated information, they keep the application and just request it. in other situations, entire packages have been returned. there's no knowing until you send it it and it's open unfortunately!
