Hi everyone,

We just got my partner/sponsor's option C printout came in..
However, We noticed that it says his marital status is single...
This is for the year of 2014 and we've become common law relationship from Jan 2014.. (Living together since Jan 2013)
So, it is our mistake that we didn't change our marital status, we were just not aware of it...-time flies...
But we're planning on filing tax together for the year of 2015 for sure.

Anybody has opinion on this? Does anybody know this is a problem..?
Is there anything I can do? Or is it ok to just send them it..?

Help please------!!!!
Thank you very much!

I'm curious about this as well actually, the one we sent in had single on it as well. We figured that was alright as for the majorty of that income/tax period she was 'single' as we were not married yet.

Yeah, well, for our case,
I now understand that technically we were supposed to file the tax together as a common law for the first time for the year of 2014 since we entered into the common law relationship in the mid of Jan 2014.
So, this might cause a bit of money owing to us for the GST/HST return we had from CRA after all.
But what I'm concerned the most is if it'll affect to my PR processing. I don't know how CIC will look at this...?

I'm hoping it would be ok...... As soon as I got marry in 2014 of April I made sure I reported my marital status to CRA within 3 months of that same year and before the next tax year, because I needed it to show I am marry on my option "C" that infill be submitting to CIC......and that's why I waited a bit longer to send in my application to CIC (which was only last month)......didn't want it to look suspicious and not showing I wasn't marry.

I guess with a good explanation or a updated copy of your opinion C to CIC would be a smart way of going about it.

maybe somebody else can advise also

Well you weren't marry yet, so I can't see that being an issues, but if they ever request for a updated opinion "c", just be sure your material status is stated as "married"

And then when I reported I was married, all my government entitlements were stop and on hold until I provided them with the income of my husband who doesnt have Canadian status yet,

I had to write a letter to CRA explaining all this as well as stating he is receiving zero income from overseas and I am his main supporter, it took me like five months before I was able to receive GST, child tax etc again - wasn't fun at all

Good luck !!

I have the same problem too

I just received my partner's option C and the status states he's single. However, we will change our status on Saturday from single to married. so I gonna request for another option C , well, its only one week to arrive. :)

in your case, you can write a letter of explanation as to why your option C stating that your partner's status is single :)

Great idea to request for a other one - submit it ASAP - at least it will show a update to your marital status

My partners had single on it as well, he was approved as a sponsor last month. We incorrectly assumed we lost our common-law status after I had to leave for Aus 3 months before him, so he filed single as we thought we had another month to get common law. I updated my status in Aus when I filed for 2014-2015 (Aus tax year is July to June) and included that.

You may need to amend his return for 2014 but CIC won't be interested in this. If you are really concerned you could get him to login to "my account" on CRA website and update status to common law, then print that off and include it with your application.

But as long as you have plenty of other evidence it should be OK :)

Great! Thank you very much!!
Yup I think we have quite a bit of evidence including over 100 pages of photos to show all our outings and trips - well, hope it'll be enough to show our 3 years of relationship..
We've got the common law declaration, bills under same address, of course joint account, IDs under the same address etc..
I heard someone saying "Too much is not too much when you collect all the evidence for CIC", so I'm trying as much as possible! Feel free to advise on this too please everybody!!

I just had another question for you since you mentioned about login to "my account" on CRA website and update status to common law, then print that off and include it with your application.
We did our tax files at H&R Block, the company who does it for you, So, do we still have the access to our account? I'll take a look at his paperwork regarding to that matter to look for the "my account" information.
But any idea where I could get those information to access "my account"?

Thanks lots!!!

and Thank you all for sharing the opinions!

Still open to more advice though! :)

For common-law, I would request another one, or provide some other proof as mentioned, as you need all the proof you can get. As for married, it's not such a big deal since it's not as difficult to prove marriage. I've been married for a couple years but never updated CRA and my option C said single. Husband was approved in under 4 months.

Yes its something everyone has access to, you can login here http://www.cra-arc.gc.ca/myaccount/ I think you may need the 2014 NOA to answer a question to confirm identity. If you've never logged in before you will need to request a code from CRA to get to the more sensitive stuff, I'm fairly sure marital status change requires this. You can also print off the option C here too, that was all we included.

I did the same thing and didn't even realize until after sending it off. I did include a printout from CRA's website showed our status was common-law. Oh well. I'm sure it will be fine.

Isn't the definition of "Common-Law" means living together continuous for 1 year without interruption.....so how can one be considered in a common-law relationship or even change the status on CRA until the 1 year has been reached. I would assume thats considered misrepresentation? Because I have my NOA and on it the status says "Single". However, I have changed it to the correct status a while back.

Umm... Are you mentioning about my case?
We've been living together for more than 2 years now without interruption. So we were considered to be in a common-law relationship FROM Jan 2014.

Ok! Thank you so much for the answers.

So from what you guys are saying,
I understand we can get another Option C printout after we change his marital status- either mailed in again or print it out from his account. Am I correct?
Also, Do they allow to change marital status when you didn't file the tax together..? We don't need to refile the tax or anything..?
