Open work permit returned am I still on implied status??

Hello there,

I have applied for inland spousal sponsorship and an open work permit. My open work permit only was returned back to me because I didn't pay one of the fees. My status in Canada expired... So I have to extend it and then resend the open work permit or am I under implied status still because the spousal sponsorship is still with CIC??

You will have to apply for restoration of your status, or obtain new status in Canada before you can apply for an Open Work Permit.

You are now out of status.

Restoration of Status app must be submitted within 90 days.

As mentioned, assuming the returning of work permit app did not include any note from visa officer specifically mentioning your status, you should assume you are now out of status. The spousal sponsorship app does not grant any kind of status on it's own, it's the OWP alone that does this.

You can submit the Restoration of Status form along with the new OWP application. You will need to pay fee for Restoration ($200) along with the fee you missed on OWP.

No I didn't because I applied online ... Can I send my receipt with the owp??

Mine took just under three months from submitting to restoration approval.

I'm really not sure. If you had sent the OWP + Restoration App, they would have processed them both at the same time. Now, you may need to wait until you get Restoration back with new status, and then apply for OWP.

I have no idea if sending in OWP with Restoration receipt will work or not.
