Dear all, I applied for Canadian open work permit after my spouse got his work permit. My husband will be working in skill category NOC A. But my application got refused with the following message:


"Thank you for your interest in working in Canada. After careful review of your work permit application and supporting documentation under the International Mobility Program, I have determined that your application does not meet the requirements of the Immigration and Refugee Protection Act (IRPA) and Immigration and Refugee Protection Regulations (IRPR). I am refusing your application on the following grounds:

• Eligibility for a work permit in this category only applies to the spouse or common-law partner of a work permit holder who is doing work that is at a level that falls within National Occupational Classification (NOC) skill levels 0, A or B. You are welcome to reapply if you feel that you can respond to these concerns and can demonstrate that your situation meets the requirements. All new applications must be accompanied by a new processing fee."

Can anyone suggest what documents do I need to submit further. I had earlier attached marriage certificate, and spousal work permit, but had not given his job offer letter.

You were correctly refused. You need to wait until he has started his job and can provide three pay slips before you can qualify and apply for an open work permit.

Thank you so much for your reply. My husband will be working as a post doctorate researcher in nuclear physics and as such has got a work permit which is exempted from LMIA. He will be joining his job in January, 2019. I wished to accompany him to Canada as soon as possible, rather than living separately for longer time periods. Can you please suggest something that we can do in this case?

hi... my visa also refused for same reason. did you apply visiting visa or again you apply open work permit?

What were reasons for refusal - through the IPM program, your spouse didn’t submit payslips and employment letter?

Did you submit the employment letter outlining the job responsibilities for the NOC?

All documents from employment side we submitted… if i apply visiting visa .. is it possible to get or again I have to apply open work permit with different job offer letter?

in that offer letter includes all the information and his responsibilities… we couldn’t find the exact reason.

He is IEC participant with work permit holder . The job title is property manager and work responsibilities are like approve rental … responsibilities for rental apartments .. in offer letter clearly it was mention with job title, NOC code and responsibilities which ever mentioned in Canada NOC website.

You should have stated that he is an IEC holder that may the issue.

Will my spouse or common-law partner get a work permit under International Experience Canada to come with me? (cic.gc.ca)

Thank you for your information.
Not sure if the refusal mentioned that your spouse is an IEC holder. Again you only provided a reason for refusal and being an IEC holder may not the issue. How long is your spouse's permit valid for?
