Hi guys,

I opolgise if this has already been discussed but I can't find a post on it.

My current situation is I'm on the IEC visa, coming up to the end of my 2 years (runs out July 14th). I'm in full time employment and the company wants to keep me but couldn't do a LMIA or PNP. I've been in the pool since January and have 421 points. I was selected for the OOPNP (I deleted my profile and made a new one) and have sent my application in last week. My question is can I apply and get a BOWP when I receive a AOR for the OOPNP? Or are you only eligible for a BOWP when you get your AOR through express entry when your actually applying for PR??

Any advice welcome,

I saw that too but what threw me off was that entire passage with Express Entry as the sub-heading. Was that indicating that applications processed via EE need to be treated differently (wait for 2nd AOR for these guys) than the applications coming in through last year's process...? I'm not entirely sure one way or the other on this.

I am in the same situation. PGWP that expires in 4 months and just applied for OOPNP yesterday. Does anyone know if I can apply for BOWP with OOPNP AOR? or what are our options?

I have same situation but little twist.

I have an ICT work permit with is valid till October 2016.
My employer wants me to send back India in October 2015 due to project complete. I have applied OOPNP last week.

Am I eligible to apply BOWP ?
What will be my status in Canada if I will quit job and stay over here ?
As my work permit is going to expire after one year which contradict the condition of minimum 4 month work permit, can I apply BOWP ?

Any suggestion is welcome.

However, the primary criteria of applying BOWP is that you can apply only if your current permit is expiring by then... Which is not in your case

Having said that.... Since you applied last week your OOPNP might be approved well before OCT 2015 and you can even apply to EE by then.

You can satay in Canada but will not be able to work here to a different employer if you quit your current JOB

Thanks OMNI, for your information, however, I have one doubt, even if I will wait till apply PR by then also I am not meeting the criteria of minimum 4 month. What should I do in that case ? should I move back to my home country and come back again after getting my PR or there is any other way I can stay and work here.

No you cant apply because OOPNP latest update says, even if u get nominated they wont provide work permit extension letter. So u can try applying paper application extension to buy some more time but result for BOWP MAY be negative.

I contacted CIC and they told me I would be eligible to apply and sent me the flowing information:

Labour Market Impact Assessment Exemption - Provincial Nominee

Generally, if you want to apply for a work permit, you need a Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada and a job offer letter from your future employer.

As an exception, you can apply for a work permit in Canada without a LMIA if you are a provincial nominee and if you have a:

Letter from the provincial government (with a certificate number) confirming that you were nominated for permanent residence by the province,

Job offer from an employer based in that province, and

Statement from the province that it has determined that all factors required for the issuance of a work permit as per its agreement with Canada have been met, and identifying the occupation and employer information.

Please note that it is not necessary that your application for permanent residence be received by CIC for the work permit to be issued without a LMIA.

Quebec-selected skilled workers are not part of this category.

The bit Im confused about is the certificate number...do we only get that when/ if we are approved or is that the number off the AOR??

It is up-to you, if you want to apply with Express Entry PNP nomination you can, but as per update, PNP wont provide any supporting letter for work permit extension ( can be confirm if you call OPNP office). On other hand, if you don't have any choice, just apply work permit extension paper application to buy extra time (u never know there is always luck factor :) )

Hey Mathew,

The information you have is correct but according to OOPNP (the new post in the link above posted by a member), OOPNP will NOT issue a letter (with a certificate number) anymore to support your BOWP application. Hence we cannot apply for BOWP without it. :( You can clarify from CIC if you like though!
