RE: Procedural Fairness Request – Federal Skilled Worker

Thank you for your application to the Ontario Immigrant Nominee Program (OINP)
under the Ontario Express Entry: Human Capital Priorities Stream received on July 11,
2017. Your application and all supporting documentation submitted to date have been
reviewed.

Before a decision is made on your application, this letter is to provide you with a final
opportunity to submit information to support your eligibility for nomination.

All applicants who choose to be assessed against the Federal Skilled Worker Program
(FSWP) criteria must meet the following provincial criteria:

 A minimum of one year of continuous and full-time employment (1,560 hours or
more) or an equal amount in continuous part-time paid work experience in a
National Occupation Classification (NOC) 0, A, or B occupation in the past five
years from the date of the PT Notification of Interest from Ontario. Applicants
assessed against FSWP criteria can demonstrate work experience obtained in
Canada or overseas. The one year minimum of continuous and full-time (or
equivalent continuous part-time) employment must have been in one specific
NOC occupation.

 A Canadian Bachelors, Masters or PhD degree or an Educational Credential
Assessment (ECA) report produced by a designated organization indicating that
your foreign education is the equivalent of a Canadian Bachelors, Masters or
PhD degree.

 A language level of Canadian Language Benchmark (CLB) 7 or above in all
language competencies (reading, writing, listening, and speaking) in either
English or French.

 Score a minimum of 400 points in the Comprehensive Ranking System in CIC’s
Express Entry system. Your score must remain at or above 400 during both the
Ontario nomination processing stage and at the federal application for permanent
residency processing stage.

 Possess sufficient funds and/or income to cover settlement costs in Ontario.
Funds must be unencumbered, readily transferable in a convertible currency, and
supported by bank statements.

 Intend to reside in Ontario, as demonstrated by a statement of intent and
indication of ties to Ontario.

 Registration in the Express Entry system, including a valid Express Entry number
and Job Seeker Validation code, is a requirement of the Human Capital Priorities
Stream and the French-Speaking Skilled Worker Stream of the Ontario
Immigrant Nominee Program (OINP).

If you choose to qualify under the FSWP criteria, you will also be assessed against
CIC’s six selection factors to ensure you meet the minimum of 67 points for the FSWP.

The assessment of the information and documentation submitted in support of your
application indicates that some of the above criteria may not have been met.
Specifically,

 A minimum of 67 points for the FSWP Points are awarded for the following six
selection factors: English and/or French Skills, Education, Experience, Age,
Arranged employment in Canada, and Adaptability.

Should the program not receive additional information within this timeframe, your

In your opinion why are they listing all these factors knowing that I have provided all evidences when I submitted my application ?.
Why they are not specific about which prove to submit?
Please note that my CRS is 315 and not 400 because I received the ontario notification in ICT week (29 june).
Please help me and tell me how to proceed. PLEASE !!

Hi.

I came to know that I m lack of a point to the 67 points at the time of NOI which has been specified in the letter. So if I claim my spouse ielts now will they accept?

That dependse on how much point you lag. Spouse's IELTS score could get you 5 points if that is what you need.

Though you had been nominated, I believe you have to inform changes to provincial office.
Post ITA, the first stage of file processing is screening in which visa officer will find any anomalies between PNP file and IRCC file.

In the above case, oinp has nominated for 2 persons (primary+second) which negatively correlates with number of applicants under IRCC (primary + sec + to be born child).

Changes has to be intimated to ontario so that they can make changes in the application.

"For all other changes, you must complete the Change of Personal Information form. This form must also be used to a request a correction of a data entry error (i.e. spelling mistake) in your name or your date of birth made while registering. Note: The program will not accept requests for complete name or date of birth changes. Once the form is completed, you must send it by email as an attachment to ontarionominee@ontario.ca indicating in the subject line “Application Change Notice – [File number]”. If you are requesting a correction to your name or date of birth, please also include the personal details page of your passport to validate your request. Failure to notify the OINP of any changes to personal information will impact the outcome of OINP and IRCC applications."

"Failure to notify the OINP of any changes to personal information will impact the outcome of OINP and IRCC applications" . Here we have to read between the lines it may impact their CIC application.

The applicant can email their helpdesk and clarify their concern. It is better to inform in my opinion.
While sending email to oinp regarding change to personal details, should we mention something in email other than subject and the attachment?

It usually happens while website is on Maintenance over the weekend. Do it on Monday, it will work.
