Hi there

What happens if i am on a work permit in Canada but while on this work permit, i want to start an outbound sponsorship application?

My husband is a canadian citizen and im a malaysian citizen with NZ PR status. If i go over to Canada this year with a work permit, but want to start a sponsership process for my husband to sponser me later...what would be the steps to take if we want to follow an outbound sponsership process?

You can apply for permanent residency (outland) while you are in Canada on your work permit. That is totally fine. You can download all the forms from the CIC website. You may want to read a couple threads about Inland vs Outland, but Outland is a good pretty fast way to go. The only inconvenience is that you might have to return to Malaysia (or area) for an interview at some point.

Thanks! Just exploring options here, but what about if i was in Canada on a TRP...could i still start an outward sponsership while im on a TRP and remain in Canada?

Yes you can do the outland applicaiton regardless of where you are living or if you're in Canada with visitor status. My boyfriends work permit expired and it was extended as a visitor and we're applying outland. If you're from a visa exempt country and have been legally admitted to Canada initially for a period of one year you may be able to apply through Buffalo so you wouldn't have to return to your home country for the interview.

The important thing is that you keep your temporary status valid - so you need to apply to extend and submit the application to the Case Processing Centre so that it's received by them BEFORE your work permit expires. The "gamble" is whether or not to apply to extend the work permit because there are a lot of conditions that have to be satisfied in order for a restricted work permit to be extended. If you have a permanent residence application in process before you have to apply to extend, you can elect to extend as a visitor based on your PR ap in process (submit proof of your qualifying relationship and your PR ap in process) because that's more likely to be approved than another restricted work permit. Otherwise, you can apply to extend the WP - but if it's denied, you'd have to go home to wait out the PR process. The good news is that an outland PR application allows you to leave Canada during processing without it affecting anything.
