Guys with nomination, need urgent help... I have sent the PR application as you may know. Now I am proceeding towards applying Work Permit.

I just realized that in the Work permit support letter, in the box "NAME OF ASSESSED OCCUPATION AND NOC" they wrote the current designation of my current company [Senior Technical Lead Engineer 2173] and not the intended designation of my future Canadian company [LEAD EMBEDDED SOFTWARE ENGINEER 2173]. In the certificate of nomination letter, under the section "Name of Occupation and NOC" they have mentioned the correct designation of my future Canadian employer. Now, is this intended or is this a mistake? Can anyone throw light on this please. Outland applications are more likely to have this discrepancy. But can you please spare some time, check your nomination letters and advice.

Hey, As far as I am aware, the position/title name does not matter as most of the companies have their internal way of handling titles/positions. Example: An Employee has a title as Developer Lead on experience/offer letter but works as a core developer on the project. So, his job duties are different than what manager performs so, his application should have the current job duties that match with appropriate NOC code code.

There is a NOC look up on their website, check both the title/positions (current and intended) fall under the same NOC. As long as Job responsibilities do not change drastically and the NOC remain same, that's good enough. You can also IRCC as well once to confirm this.

Either No for national ID for India or You may enter Adhaar card # and date had you received it ( approximate mon/year is fine) . It's Exp date remain blank. Couple of my friends added aadhar # as national ID and got WP approved. This field has no role in WP decision anyway.

I am not an expert lol but can try to provide the response based on my knowledge. You got 30 days to clarify why is there NOC discrepancy on your OINP application? Actually, I'm not sure how come both current and previous Offer offers have a mention of NOC code unless customized offer by employer. Do you meet below OINP requirement?

You must have:
  • at least two years of paid full-time (or the equivalent in part-time) work experience in the same occupation (same NOC code) as your job offer gained within the five years prior to submitting your application. If your work experience was gained in Canada, you must have been legally living and working in Canada

When I was doing the online application, it asked me for the NOC code for each job including my current job in Canada NOC 1212 which is under 1 year. So they would have to assess me based on my previous job which I put as NOC1111 but is similar to my job in Canada. I have 5 years experience.
Now I don't know how to respond and I need the nomination. Please help

I am not sure what they are looking for - Are they trying to evaluate your NOC eligibility? If yes, then here is my suggestion: If you have a proven work exp of least 2 years in a NOC 1111 (WITHIN last 5 years), You can provide details about that job and justify you meet the requirement. You can write a detailed letter with highlighting bullet points clearly how you meet the requirement. At the bottom of that letter, provide all supporting documents ( an Exp letter from that employer having the job duties matching NOC 1111, reference of friends worked in that Organization, Payslips -1st two and last two, Tax statements of all years worked under that NOC, a Job offer letter etc.) . you can call OINIP as well to see if they want you to add some specific details. It's your call to provide details as per their need- good luck !

So what happened is that I applied to OINP -Employer Job Offer and they sent me a notice of intent to refuse application because the NOC that I am working in is NOC 1212 but my job letter to prove the 5 years work experience is NOC1111 even though the duties are similar. What should I do to respond to them

Hi, I'm just giving my opinion.

You mentioned that OINP, in Work permit Support letter mentioned your current designation not the future designation under "NAME OF ASSESSED OCCUPATION AND NOC", Right?

As the name "Assessed" says, they'll consider the present employer as you're currently employed. I fyou're not employed and are going to have a job with your future employer, then they would have mentioned "LEAD EMBEDDED SOFTWARE ENGINEER 2173" under that (Or might leave blank as you don't have job when applying). I would assume they made mistake if both sections are with name "NAME OF ASSESSED OCCUPATION AND NOC", which is not. They're of different names and the word "Assessment" plays a role in understanding the difference.

When it comes to IRCC, I think they look at both documents as they're important for issuing your Employer specific work permit. When mentioning your employer, I suggest you go with future employer as that makes you eligible for getting Visa and port entering (Your OINP work permit support letter is not valid, as you'd be resigned already with your current employer and Airport authority don't trace back to your Country's employer. This is my understanding).

If you have time, you can go ahead resigning your current employer and ask OINP to give Work permit support letter with your future Canadian employer (which is valid and they should do it.)

Like I mentioned, this is what I understood and completely to the best of my Knowledge. You can wait for some other's opinion or clarification.
Agreed with your hypothesis. I thought the same too. Thanks for the explanation. Lets see how it goes.

They are saying that the NOC that I am in now must be the same since the last 5 years

Sure thanks. I would like to keep stuff crystal clear. Employer is sponsoring my WP through Fragomen lawyers. Waiting for their response.

Thanks @chivinas I would expect so, since you are working for the same employer now. My case is a bit different. Employers are different and outland application.
