Not able to get work expereince letter. Suggestions needed

Hi

I would like to briefly share my condition. I have got ITA (496) score which includes 26 points of the work I did in my home country (india). I am currently on a PGWP after my PhD in Canada. I have almost arranged everything which the CIC required me to upload except for the reference letter for the job i did in India. I have tried many times to get the letter from my supervisor/admin but they have refused to issue a letter stating my job responsibilities. I am confused now with what to do next and am considering these options

A) send CIC what ever docs I've got for the job in India (i have a leaving and work experience certificate mentioning about the time i was employed and my annual salary) and explain in the explanation letter to CIC that I have been refused by my supervisor about mentioning any work related details in the letter (have email proof)
Or
B) Decline the ITA and update my EE profile by removing the job in question and wait for new ITA (i'll still get 470 points)

I would really appreciate any sort of suggestions from these two options or any other that you guys have for me :(

You have very few option.

Under a normal circumstance, an applicant without (a proper) job reference/work experience letter would not be considered.

Wont CIC still consider the rest of my docs where I show my current job experience in Canada (1.5 years) and my job offer (till 2018; LMIA exempt)? I have proper documentation in terms of reference letters and salary slips for the job in Canada but its only the 1 year job that I did in India that I dont have proper ref letter. Do you think they'll decline my application?

To avoid the hassle, I would suggest you to recreate a new EE profile, without stating the job experience that you couldn't get your job ref. letter from.

Your EE score is high enough that you should still get ITA without that job experience.

I am not absolutely sure about this but as long as you are showing ur work experience docs that is related to ur current NOC, then u r fine. In ur situation just make a new EE profile and mention the job that u r doing in Canada and present all the related work docs from this job. U r still going to hv 470 score which is good enough to get an ITA.

Ok. So to make a new EE profile should I first delete my existing EE profile, decline the ITA and then make a new one or can I make an all togther new mycic account and make a new one? Can i have two active EE profiles?

U can have only 1 EE profile at one time. So, in order to proceed with the new job details, u have to create a new profile.
But before doing so, I would like you to confirm this with the senior members of this forum such as Asivad.

Read this at CIC website "When reviewing an application, processing offices must determine if

the applicant possesses the qualifications that they declared in their e-APR, as corroborated by the applicant’s supporting documentation; and
when the applicant submits their e-APR, the information provided in their Express Entry profile has not materially changed to the degree that the applicant would not have been issued an ITA in that round of invitations.
Accordingly, officers should refuse an application under section A11.2 if it is determined that

at the time of the ITA or e-APR, the applicant did not or does not meet the MEC, which includes the requirements of the program to which they were invited to apply; or
the applicant’s recalculated CRS score has fallen below that of the lowest-ranked candidate invited to apply in that round of invitations."

So in my case even if they decide to not to give me points for my foriegn work experience, i still have my 1 year canadian job (current) which will make my score 470 (higher than the minimum cut off in the round). Do you guys still think I should apply with the current EE profile or make a new one?

I think you can go ahead as is, include the copy of the contract & whatever other letters you have for it, include the trail of emails that they refused the letter & if possible get a letter from a colleague there confirming you worked there, the job you had etc.
It's not a definite as it depends on the officer who reviews it but I've seen others submit the above when they were refused a letter & be approved. If the officer decides not to count those & recalculated your score, as you say you're still above the point cut off for that draw so would still have gotten that ITA.

Yes, I agree with purplesnow.

I would suggest the following.

1. Arrange copies of all the documents that you have in your possession related to your job in India.
2. Contact a colleague who is still working in the previous company and check with him/her whether they would be willing to give you a letter which states your duties and responsibilities. If yes, then get it on a white paper, get it notarized, along with a copy of his/her employee id card and visiting card.
3. Prepare an LOE explaining the situation and keep all documentary evidence of your communication with your previous employer and submit all of it together.

I think the above should help (provided you can get it), otherwise, submit whatever you have and hope the Case Officer understands your situation. After all what matters is that they should be convinced of the genuineness of the situation.

Actaully the job that I did was almost 8 years ago. All of my good friends have now moved to different jobs now. What do you think can they still write a reco for me as they themselves were appointed at same post as me and were there even after i left my job and came to canada for my phd?

In that case try the following as there is no other way I can think of (If I were you, I also would have done the same).
1. Contact your ex-colleague who is willing to provide you a letter. Get a visiting card of theirs (both old company, if they still have one and from the new company as well for latest contact).
2. Get the letter notarized.
3. Prepare an LOE explaining your situation and submit the above will all other employment documents - employment contract/ salary slip/ tax documents/ relieving letter etc).
