Hi,

I have found the NOC 4012 Post-secondary teaching and research assistants to be self-contradictory for application of CEC.

The employment requirement says "Enrolment in a university or college program is required."

However, there is another policy which states any experience gained while doing full-time study is not counted.

So the question is, can the non-student(people who are not enrolled in a university program) who works as a TA or TA for a year apply under this occupation ? Or is there a different NOC code for this situation ?

Yes, according to service canada's webpage, it's actually possible that TA/RA can be conducted while not being a graduate student, although the number is small.

"Owing to the nature of this occupation, very few workers stay in this group after completing their studies. The proportion of assistants aged 55 and over in 2006 was much lower than that of all occupations"

Although the number is small, it doesn't deny the possibility there.

Not self-contradictory - they are different agencies, different programs. HRSDC creates the NOC classification system which is used by a number of federal programs. CEC is one of many immigration programs, which has its own set of rules. You could be working as an IT consultant with an off campus work permit, but as long as you have student status, that work is not recognized either.

I can imagine this for an RA but not a TA. Yes, you would have to find a suitable NOC based on your field, such as

However, the other NOC codes 4161,4165 seem not matching the duties perfectly.

The duty performed is actually almost same with 4012(which contains both TA/RA), except the fact that I'm not actively enrolled in a university program anymore.

who should I contact first to get a authoritative clarification ? CIC or HRSDC ?

I would first ask your employer.
 
applicant does not need to meet the “Employment Requirements” for the particular NOC

see section 6.1 of the link below.

I think you will be fine under NOC 4012.
