The only thing you can do is to wait for the ITA cutoff to hit 453 again!
Of course, go ahead and claim that work experience if it was a totally legitimate job! 26 points can make or break your PR dream in the short term.
Try talking to your old colleagues, supervisor, senior managers from that organization to see if you can wrangle a reference letter from them which states whatever CIC needs on a reference letter. Then you can submit that along with their business card and upload it along with an LOE which highlights all efforts undertaken to procure reference letter, cross references that email refusal from your past employer as well if needed and requests the VO to consider your case favorably in the light of these circumstances. That should do it.
If you're unable to get colleagues to do this, as a last resort get a self-declaration for that period of employment which lists down all the facts pertaining to that job in the format that CIC required, get it notarized, upload that with all other supporting documents along with an LOE which highlights all efforts undertaken to procure reference letter, cross references that email refusal from your past employer as well if needed and requests the VO to consider your case favorably in the light of these circumstances. That should do it.
