Don't worry please. I think I am an exception and that it's pure bad luck for me.

I wanted to make it honest so I tool all my contracts and everything I had from my home country plus when I was working abroad, and I submitted that. I didn't match the wording of the NOC duties, but used my company's one for the same duties. I should have done it differently. I was just too sure of myself. And I paid the price.

Also, they should have checked this before charging my CC, so I think in the 2nd verification my file ended up with a strange person who decided to refuse it.

Please don't worry. Those things are rare, will not happen to you!!!

I don't have the files with me now as I'm on a business trip. I will post you the duties as soon as I'm back home this weekend.

But as I explained above, the duties are pretty much the same, just the wording I is different.

I didn't have a reference letter, as I couldn't ask my HR to do it, so I put all my contracts, and many other stuff and added an accompanying letter to explain why I did that.
Maybe that was the problem... I don't know.

For sure what is stupid it that with my 11 years they didn't take into account one single year... Super strange...

sorry to hear that as i've been reading your posts from a while. One thing you've said thats got me worried now is that, in my letters, my managers too didnt use the exact wording/phrasing of the duties listed in the NOC. In fact, i've read a lot of posts where seniors said not to include duties word by word but of course as long as they match whats listed on the NOC. I would think its ridiculous to match it word by word because that wouldnt even sound legit. Again, i wish you all the best and like they always say never give up. From my own experience, as a former international student in canada, i was rejected the first time i applied for a student visa, and i was so dejected. But i applied again and got accepted second time around. I know a student visa is no comparison to applying for immigration but just to give you some hope.. I've got my fingers crossed. Thanks for sharing your experience here.

So they technically charged you and your application status online showed In Process and then they rejected and sent your application back?

21 Oct app are still waiting for CC.
Realistically speaking ... I think it is capped already .
Sorry to seem so negative but it is better to face it and react on EE ... May be we get a better chance there

Don't worry please. We will never know what exactly didn't match in my app. Each and every of our cases is unique and I really believe that I was just unlucky. When I get home this weekend I will try to check in details the duties and matching, and if I come up with something logical I will let you know.

But, please don't worry! :)

Yes, they charged my cc on 26-11, my ECAS showed in progress on 16-11 and it disappeared on 02-01-2015, and the return letter was dated 31-12.

I only found one more case like me on the forum, and it was from last year or even before. So I think I was an isolated case.

I really do not want you guys to worry now! Please!!!

I have one more question. I read that they will refund the fee. Is my understanding correct???? Do they refund it in such cases?????

To be honest I'm not sure what is the practice about the refunds. If I understood well, as long as it is at CIC the app gets refunded. When it goes to VO they will not refund it anymore.

For me they stated in the letter that they will refund it to my credit card in 12-16 weeks. So we'll see.

While I am sorry to hear about your case, it sounded really strange (to me) that they will refund CC charges after an NER.

If you read the process steps:
1. Application Reaches CIC, is placed in order of arrival
2. Application is opened and checked for completeness
3. CC is charged for processing
4. PER/NER is issued and
5. e-File is sent to VO for processing

I was always under the impression that CIC charges for the processing (allocation of points, checking for completeness and fwd to VO).

Wow! If what you say is true - you are indeed lucky to have gotten away with a scratch. Now all you have to do is reinvest that money and your "free" learning to Express Entry and we will meet in Canada soon. :)

Thanks! I keep on thinking that something crazy happend with the processing order of my app. I guess it is just bad luck.

To avoid any confusion, I will try to upload tomorrow all the pages from the letter I received. You will for sure be able to see better than me what is the story about.

I will also go through all the pages of the returned app when I get back home this weekend to see what they were writing on it, as I saw some comments done by pencil. This might help me understand better what has happened. And if there is something useful, I will share it with you guys.

I don't think that the cap has been reached already. They are just starting to charge the 340 "pending MI review applications", if you can still remember, the count update last december 16, was just 482. basically, there is still a buffer of 178.
