She called CIC and they told her she did not need it. He can include a letter with his application explaining why he does not have tax info. Should be fine.
The sponsor is supposed to include the Option C form from his income tax, but if he did not file income tax, and has no income, then he should just write a letter explaining this situation and include it in the application, in lieu of the Option C.
I did this when I sponsored my husband - I had no Option C and no tax info for the previous year. I just explained my situation. There was never any problem with this during the process.
