Correct - no points if you are on an open work permit. Your employer needs to obtain an approved LMIA in order for you to get the 50 points.

Hi Scylla,

Your employer is the one who has to obtain the LMIA. It is a long process and quite involved for the employer - and can take 4-6 months to complete. Talk to your employer and see if they are willing to do it. Details below:

https://www.canada.ca/en/employment-social-development/services/foreign-workers/median-wage/high/requirements.html

If your employer is obtaining the LMIA for the purposes of supporting your PR application, they don't pay the $1,000 fee. However they still have to advertise your job and prove no Canadian could be found for the role.

Oh I see, how about if the LMIA is an Exempt LMIA and the work permit is Restricted for that employer only, can my niece get the 50 points on that? Thank you.

How did she get a LMIA exempt permit? NOC? Has she worked a year in Canada?
Her employer is Non Profit Organization (Charity) and is exempted from LMIA under International Mobility Program, her NOC is Early Childhood Educator and Assistants-42202, she has been working more than a year now and her work permit is Employer-Specific.
So, would she get points with that?

Also, below is the question, what could be the correct answer here, I am confused if I have to choose letter c) or letter e) .......thank you:

*Was a positive Labour Market....(LMIA) issued for the current work permit?
Please select:
a) Yes
b) No
c) No-My work permit is exempt from an LMIA due to an international agreement
d) No-My work permit is exempt from an LMIA due to a Federal-Provincial agreement
e) No-My work permit is exempt from an LMIA for other reasons and is employer-specific
