To my understanding, you'd only get the 50 points in this case, without an LMIA, if your previous work permit had the employer named on it:

Hope someone else can correct me if I'm wrong, but it does sound like you wouldn't be able to claim points for this job offer.

^ The way I interpret the "valid job offer" for Express Entry is that you would have gotten the points if you did have a positive LMIA to support the job offer.

So while you did answer the questionnaire truthfully to your situation, the system is correctly not crediting the points.

Again, I hope someone smarter can clarify.

Correct - no points if you are on an open work permit. Your employer needs to obtain an approved LMIA in order for you to get the 50 points.

Your employer is the one who has to obtain the LMIA. It is a long process and quite involved for the employer - and can take 4-6 months to complete. Talk to your employer and see if they are willing to do it. Details below:

If your employer is obtaining the LMIA for the purposes of supporting your PR application, they don't pay the $1,000 fee. However they still have to advertise your job and prove no Canadian could be found for the role.

Oh I see, how about if the LMIA is an Exempt LMIA and the work permit is Restricted for that employer only, can my niece get the 50 points on that? Thank you.

Her employer is Non Profit Organization (Charity) and is exempted from LMIA under International Mobility Program, her NOC is Early Childhood Educator and Assistants-42202, she has been working more than a year now and her work permit is Employer-Specific.
So, would she get points with that?
