Friends,

I noticed file transfer for most of applicant from Buffalo to other Visa Office in USA;
but my file is processing in Buffalo Visa Office (no file transfer).
Does it affect or reflect some worrying case or it is normal?

thanks for sharing your experience & views.

pooja123, there is nothing to worry, its normal. When buffalo have many file backlogs they just send to other consulate to make process faster. I guess it could be better if file don't get transfered, as after my file transfer my days counter has been reset to zero, they wrote to inquire only after 90 days of transfer and its already been 90 days after I submitted all the documents but I hope to see some changes really soon :)

Thanks for reply... It was helpful.
(As usual, when it comes to own case, I had two thoughts and wanted to confirm with fellow members. Thanks.)

I got transferred mid July and yes, mark_imim I think that they reset the counter back to 0 with the warning not to contact within 90 days from the date of email. However, being with MAJORITY who has been transferred make me more comfortable. If I were pooja123, I would be concern.

I read few weeks back on this forum that even if applicant has 67 points vo has authority to refuse visa; vo office gives opportunity to prove the facts and applicant is obliged to provide (follow) those guidelines; so I think it is up to vo to decide. Being with majority definitely helps to be relax but not 100% surety.
It is up to God what way God opens for me :).

Even though you have at least 67 points, the officers can refuse your application. There are tens of thousands of applicants who have 67 points or higher. The officers need to maintain their yearly quota. In that case, they need to find our weaknesses for refusal. If applicants seem to be very qualified but cannot be granted immigration due to the limitation of the year, their files are held in queue.

Even though we have at least 67 points, to me, the officers may assess the following to prioritize the applications for those who have at least a few.

1) At least one year of education in Canada
2) A significant length of time spent in Canada legally (for school, work, etc)
3) At least one of work experience in Canada
4) Applicants from UK and France
5) Clear documents that clearly show full eligibility
6) Have arranged employment
7) Have relatives in Canada
7) Already working for big organizations in Canada

My friends who had gone through the above-mentioned criteria received visas earlier than others.

I didn't meet any of those 7 criteria. Poor me
1) No education in Can
2) Been to Ottawa for 1 week-winter-vacation
3) No work xperience in Can
4) Neither UK or France citizen or at least resident
5) Clear Documents but not sure about showing full eligibility (it's my education and/or work experience and strongly dependent on how the immigration officer felt while reading my application)
6) FSW1 not 2 or 3
7) No direct relatives in Can...

As per my understanding you do not need to worry even if you don't meet above seven criteria;
as I do not know official policy, but as per other applicant's experience, I believe, once applicant get 67 or more points;
vo ensures if applicant can get job and be self-sufficient (and not burden to Canada govt.) + checks for official stuff (validity of submitted docs + medical + security etc).

And reason for above assumption is because few weeks back one applicant share his case;
he had 75 points + he had his uncle living in Canada + POF 26000 (required in his case was 23500) + ILET average score

But vo asked to take ILETs again with high marks. Reason is that he is in teaching profession; and vo felt that person with avg. English may not be able to establish easily. His uncle was working but unfortunately during that period his uncle claimed unemployment benefit; now vo might have felt that if he would take time to get establish & his uncle may not able to help him as he is claiming unemployment benefit; this applicant may become burden to govt. With good English only he can get teaching job easily; so applicant was asked to prove good English.

Last but not least - everything above is based on assumption - nothing official.

Thanks for the detail reply, pooja123. I'm not really concern about the application (if I don't want to say) I'm confident that I'll get it someday, it's just the matter of time ;). I just said that I didn't meet any of those criteria for the application to be queued or held, whatever.
And yes, IELTS should be a must for non native speaker. Keep on updating, sharing and ...cheering... Good luck everyone

You don't have to worry about this. This is just my understanding. If you meet the above, your application will just be processed faster. My friends are a good example. I have been in Canada for nine years for school and later worked. My file is taking about 20 months. I meet 5 of the above. The reason why my file took so long is that my documents were not clear and submitted them seperately. This is why the officer had to spend time to figure out whether I meet the minium requirment as a skilled worker. Someone who has more clear documents was placed ahead of me.

My suggestion to all applicants is submit all documents at once that meet at least the minium requirement. For example, if you don't have at least one year of full time or equivalant (37.5 hours / week) continuous employment, your file will be rejected or the officer has to figure out (it will obviously take time) whether you have one year of work expereince.

I hope you have everything clear. It's just a matter of time. Sooner or later you will get. We skilled workers obviously can add a lot of value to Canada.
