hello everyone

I had some question regarding my sisters wedding to someone who entered legally to us with a f1 student visa but is now out of status (it's been 7 months since he dropped out of school)

My sister is a Canadian citizen. We would like to go to Pakistan to do the rukhsati (bridal send off) since our the grooms entire family is there and so is our extended family, aunts uncles, grandparents and cousins.

However because we have friends here we though if doing one event here so we decided nikkah only and that too in the U.S. obviously after the Nikkah they will be together but won't be living together.

HOWEVER this is an arranged marriage!!!
Now my questions are:

1. What would make this case stronger if my sister were to apply for spousal immigration?

2. Should we do the rukhsati (bridal send off) as well or is it ok for us to do the nikkah? I've heard a lot about cases being rejected from Pakistan on nikkah basis.

3. If we were to hire a lawyer and they would file the application, and the groom gets called for an interview, would he have to go back to Pakistan? Or can this be done thorough the US? He will not be able to enter the US again.

4. Last question: can we apply for some sort of visitors visa or some other temporary residence/vista visa after the nikkah so that he can visit us in Canada? (I highly think this is unlikely considering he's out of status now, but I'd like opinions).

1. Outland Spousal Sponsorship will not grant him a status. To ensure that the spousal sponsorship is not refused, I think he should go back to Pak, and after Rukshati is done, he should apply from Pakistan.

2. Rukhsati is important in Pakistani culture and CIC knows that. Nikkah only cases have to face interviews and refusals.

3. If you file outland and the PA is called for an interview, his interview will take place in Islamabad, Pakistan.

4. In this particular case, temporary resident visa will most likely be refused.

Agreed with all of the above - no chance a TRV is going to be approved since he's out of status. It's also going to be harder to prove the relationship is genuine since he's out of status - so Rukhsati needs to be done.

He should also be aware that he'll be banned from the US for three years as soon as he leaves. This ban will increase to 10 years once he's been in the US for a year without status.

I actually had one more question, how would we show the government when applying for immigration that we did the rukhsati (bridal send off)? E.g. Would we show pictures or video, if so how?


Also what other methods would we have to use to demonstrate that we indeed do the rukhsati?

Read the application guide/instructions and document checklists thoroughly to know what proofs you have to send.

Pictures of events/bridal sent off, post Rukhsati rasams, honeymoon pics etc. Videos are not accepted.
