Compliments of the season to my fellow Nigerians on this great forum,this is actually my first time of posting to this tread,though i belong to the set of people that applied after june 26th 2010,i sometimes read what is going on this particular tread(Naija forum).i have a situation and i would really like wonderful people in this tread to help me,i submitted my application to CIC on the 1st of November 2010,but my application returned on the 23rd Dec 2010,according to the cover letter sent with the returned application,they stated that my credit card declined when they tried to remove the money,they actually tried more than 5 times without success,hence they return my application,i am about to resubmit the application now,my question is should i just submit the 'old' forms returned or print out new forms,fill and submit,people on my forum(applicants on or after june 26th) have different opinion about this,CIC s however stated i should submit the cover letter sent to me when i am resubmitting and they said they do not have my records.please i need your advice on this especially from people that were in my shoes.Thank you so much.

First of all. You need to clarify the issue of the CC with the issuing bank. Make sure you are using chips and PIN card and submit same docs. Your application will be treated afresh. so referring to the earlier application will not matter. You also need to act fast before your NOC group get filled.

Sorry this is coming a bit late, i did try to send it some days ago, but the site was acting funny, threw me out and i lost all i'd written.

This is very similar to an app i was privy to, except that that the other fellow contacted Accra and notified em of changes in his marital situation and not the other way round.

Accra contacted you cos u'd stated in d forms that you were married but that your spouse wasn't accompanying you to canada. Thing is, CiC examines all family members whether accompanying or not. However there are exemptions(see R23 in OP1) for

1. separated spouses
2. children in custody of non-accompanying spouses.


Any member of the family not so examined loses the right to immigrate to canada under the umbrella of the main applicant in future. Your estranged wife falls into the first category, but you weren't pro-active by notifying Accra of the marital situation. I would do them a letter(along with requested docs) if i were in your shoes, and

--State that the marriage has broken down
--You have ceased to live together as man and wife
--Communication is now only through 3rd parties/family/solicitor etc
--You are about to commence divorce proceedings(u need to do this b4 u leave 9ja, d power base changes into her favour if u shd land in canada and she wises up to file for divorce, and u won't be free to move on in canada if u dont complete the dissolution in 9ja)
--You could get a lawyer to do a letter to back this up for you too.

You can fill out the imm forms to the best of your ability on her behalf, and leave the signature part blank, and then attach her pali or your marriage certs for cic to reference her signature if need be. Not much can be done about PCC, cic would see reason in this circumstance.

Most likely, Accra will send you a form to fill out and take to the Courts/Notary public/commissioner of oaths for stamping and declaring that your estranged spouse is aware that she is loosing her rights to any immigration benefits derivable from your status in canada . This was what the other guy did, and he's now happily remarried in Calgary.

NB: Not sure of your full app pix, but be mindful that this separation may cost you points(if u'd claimed any) under the adaptability factor and this could be anything btw 3-10pts. Pls do your maths, and see where you stand pointswise on a solo level before you proceed.

Now CIC requested for her DOB, police report and schedule 1 form of my spouse, I called her and she said she is not interested in the process.
Now what do I do? We have not official divorced
Can someone please suggest what I should do.

We gathered on Sunday 26/12 as scheduled and had the following in attendance. Ig, Seglad (chaired the gathering), Odeks, DYDX, Spokes and myself. Oloye called in from Brampton, Jackson from Zaria and Ind dan. We commenced the gathering with prayer and thereafter introduced ourselves.

Seglad then asked members to agree on the objectives of the meeting and the following were agreed.

1. Advise each other in the area of immigration to Canada
2. To render assistance to one another in the accomplishment of our goal(s)
3. To be our brothers' keeper after landing in canada/help integrate new comers to canada

One major issue that was emphasised was the fact that we should take this gathering from nigeria to canada and become a community of new breed of nigerians looking out for the other nigerians when we finally achieve our dream of residing in Canada;using the Asians, Indians and the likes as reference points.

Attendees tabled their respective questions/issues/challenges with regard to their cases, and I believe each got a satisfactory answer to his/her question. Oloye was on hand (via telephone)to answer questions regarding landing etc.

The date of the next meeting has been fixed for February 26 2011 at 4pm. Venue will be communicated later on.

P s Mr Chairman, hope I didnt leave anything out.

Sincerely, am impressed. But I will challenge us all. The beginning of a matter though very important. The end justifies it all. I am looking forward to the Canada side of it. His grace is available.

=N= 25K for adults at the DMP at VI as at the I did mine. Additional tests cost more if need be.Not sure the cost for children.Check CIC website for list of DMP in Nigeria and their phone number so you can call to make enquiry about their latest cost.

Infact, what a wonderful gathering! Big thanks to Madam Ig for the initiative, the participants and those who phoned-in. We do hope others will find time to be part of us in the next meeting. Odeks, thank you very much, all the way from ilesha, your presence was really appreciated. Ig, Spoke, DyDx, mot, you are all wonderful people without you nothing could have been achieved.

Oloye, we really appreciate the warmth kindness and the time shared with us during the meeting. We shall further appreciate if you can co-ordinate other landed nigerians, so that when we all move to canada,join and continue the group over there. Who is an accompanying family member?
An accompanying family member is a family member of a principal applicant who receives a visa
at the same time as the principal applicant to accompany or follow the principal applicant to
Canada. An accompanying family member cannot seek permanent resident status before the
principal applicant.
Family members of refugee applicants may, under certain circumstances, be processed and
issued permanent resident visas up to a year after the principal applicant has been granted
permanent resident status in Canada. See OP 5, section 25, One-year window of opportunity
provision.
With the following exceptions, R23 and R70(1)(e) require foreign nationals and their family
members, whether accompanying or not, to meet the requirements of the Act and Regulations,
including admissibility requirements:
• spouses or common-law partners separated from and not living with applicants (the applicant
must submit written evidence of the separation); and
• children of an applicant or an applicant's spouse or common-law partner who are in the legal
custody or guardianship of a former spouse or common-law partner.
