Yes I did. Well, they might not take as long as the VOs do, right? So it's worth the try... Anyway, this forum really do helps a lot and it might help future applicants with the same concerns, too.

Hi everyone, I have few concerns again regarding our app as I read through different posts and threads from this forum. Hoping anyone would be of great help, please.

I have 2 kids from my former (and still, actually, coz I haven't filed for annulment/divorce yet! *NON ACCOMPANYING*) husband, both named after him but in my full custody. We no longer have contact with my ex so I continued on with my life...
My 3rd baby is with my current partner(conjugal; *ACCOMPANYING*), who left for Canada in Sept 2015 as a landed immigrant, declared single & no common-law/conjugal partner. Our child was born in Oct 2015. He sent me an "Affidavit of Acknowledgement of Paternity and Use of Last Name" on Nov 2015, but I have already registered our child on Oct 2015 as an illegitimate child and father's section as UNKNOWN.

In my partner's application forms, he declared our child and not my 2 kids. He passed Sponsorship Eligibility so we're kinda assuming everything is ok in his side, but still wondering on my side...

My questions now:
1. Can/should my partner update his family background in our app - acknowledging my 2 other kids? How can we do so?
2. Could this probably result in the delay of our app? I was wondering if we should act now before they even ask for additional documents.
3. I have sent my own 5-page, notarized Affidavit explaining each and every situation there is to ask, from my previous relationship to present, including the illegitimacy of my youngest child... SHOULD THIS BE ENOUGH?
4. How can he declare our child in all his data in Canada??

Your situation is obviously quite complicated. You mentioned your 2 kids from your ex which is obviously your husband because you mentioned you have not filed for annulment yet. Having said that, your 2 kids with your ex should of course bear the father's name. Your 'now' partner is the father of your 3rd child. You mentioned your partner left in September 2015 and his child was born a month after. Definitely the child is considered illegitimate. I have to ask though, why did you not put the father's name on the BC?

Your partner cannot declare your 2 children as his dependent as they are yours. Your 2 children should be your 2 dependents posted on your IMM 0008 form but non-accompanying.

For no. 1 question, the answer is already mentioned above.
For no. 2, sorry but, most likely.
For no. 3, I hope the Affidavit works.
For no. 4, that is a good question! How can he, esp if he was not even mentioned on the BC.

I missed out what you mentioned that your partner left on September 2015 as an immigrant and declared himself single. If you are applying as Common-law/Conjugal Partners he should have declared you as his common-law partner when he applied as immigrant.

You must be confused why I didn't atleast mention my partner as the father, well, my family and some lawyers suggested to do that just to avoid future complications or legal problems regarding with the valid marriage I am stuck into. Although I haven't heard from my ex for years, I would still end up incarcerated if found guilty for Adultery... Also, the law firm says I can't just use here the Affidavit my partner sent me because he still has to sign the BC personally.

No worries, I understand. On the Affidavit, yes, it is of no use anymore. Not only that he has to personally sign the BC but the fact also that you already had it registered even if he sent you an Affidavit.

We just wanted to try our luck back then, I didn't expect it'll give much more complications now. I was able to use it as a proof for our TRV apps too (denied twice btw). Really hoping the best of all lucks to visit us soon

Just saw this now... He was actually sponsored by his sisters as their parents' dependent. They didn't know how to file or change it and all, and they were already at the later stage of their application. They waited about 6yrs for it so I guess they just didn't want to complicate it any longer...

May I ask when did your conjugal relationship start po? And will it have impact if di niya nadeclare upon landing?

Sorry I missed your question... Our relationship started on March 2013. That I am not so sure of, and really reallyyyyy hoping it won't be another problem for them to concentrate on

Dapat declared sya para counted yung times na magkasama pa sila. With that, the Common-law app should be a good-to-go to be considered.

Sa conjugal, di ko masyadong sigurado. Di ba kapag Common Law tas di dineclare, di na pwedeng makuha. Sa Conjugal, di ako sure if ganun din. Pero dapat nadeclare po.

Hindi po alam ng partner ko pano at kung saam magdedeclare or magasikaso ng legalities nya nga eh Umaasa lang po sya sakin mahina po loob nya....

If you're asking about your case, if si hubby mo PR na pero girlfriend ka pa lang, then later umuwi sya to marry you, Oks lang yun. What you have sent with your application should be fine.

Dapat talaga declared yung sa case ni Queeen.14. Otherwise, they will have to show proof na they were together for at least a year prior to filing an app.
