she used to live in South Africa. the problem with her case was like this..
she had visitor visa to visit her sisters, and then she got a job offer, she applied to get a work permit through agent and he lost her passport. meanwhile she got her visitor visa expired. so she had no other option but to apply for refugee. on the other hand, she NEVER got refugee status itself. SA government gave her a temporary residency that she can live and seek employment in it. that TEMPORARY residency means, as far as i understand, given to the person who is still waiting on his result to be refugee legally.( and she didnt get reply, and upon expiry of her TEMPORARY residency, she went to the office and they extend her stay by another 3 months( as she was still waiting on for her result)

while she was waiting for the results, she got her new passport and then another job offer letter. so she took her application back for the refugee(as she never seek that status) and then continue living with her work permit.

she applied only for south africa and no other country and she never get a refusal. also she withdraw her application for the refugee quite before we came in contact. and then she continue living with her work permit. ( logically, if she wanted to live there at any cost, she would never haven withdrawn her application( on which she could have lived and worked for her entire life). instead she continue living with her work permit and thus we have a reason to prove that she had to apply for the refugee as she had no other option but as soon as she got the job offer letter and new passport she converted her stay in to work permit.
I am planning to apply to the NDVO for her case. lets hope for the best

oic.. so since she did not actually take refugee status.. she should be okay, maybe she doesn't need to mention it unless there is an actual question asking if she ever had refugee status. Since she is legally living and working in South Africa, it should be a straight forward case. Just make sure you submit medicals and PCC for South Arica and India with the application.
And what an irresponsible lawyer... losing such an important passport. I can imagine her stress at that time. Good that it worked out for her.

What I was reffering was Schedule A Backgorund /Declaration form IMM5669(12-2012)E. Under Question number 6,

"Have you(my wife), or, if you are the principal applicant, any of your family members listed in your application for permanent residence in Canada ever...(clause-C) ..made previous claims for refugee protection in Canada OR at a Canadian visa office abroad, in any other country OR countries OR eith United Nations High Commissioner fr refugee(UNHCR)???

Doesn't it mean that even if she just have applied( and not have EVER got it actually) She has to mention it in this form under this clause?? Or would I just have to fill it up if she has actually earned it??? What do you suggest?

hey dear,
now even i would suggest that dont apply for TRV, i applied for it for my wife.. and looks like NDVO sent it back even from its doors. i mean it was rejected in less than 3 days.
reason.
1. travel history
2. family ties in canada.
3. not enough reasons to come back.

Plus in return we got disappointment..

u can go for an upfront medical exam just 2 or 3days early before sending your forms to the CPC-m office.

Yes you can do medicals before applying in June 2014. I think it is better to attach your original medicals with the application and send to NDVO. All the best!

did this mean we cant take upfront medicals little far like about a month?? ??? I just had my wife's exam in starting of feb and we 're gonna apply in about in the end of the Feb/ starting of March as we still havent got her PCC from another country she lived in.... :-\

Yes thats no problem. Did you do medicals or pcc yet? If so send these originals with the sponsorship application to NDVO when you are ready. All the best!

I did medicals for my wife on Feb 3rd. we have her PCC for India but we are awaiting from South Africa.

Sorry to say NDVO. I meant send to Mississauga. You are correct. Do you have any idea how long will you get PCC from South Africa? Hopefully you will get it soon and make sure to send more proofs like conversations and pictures if you can. All the best.

hi Shining Moon,
wht i suggest u is dont waste ur time..plz send ur all documents to CPC-M as early as posible to save time..You will have to include the following thgs,
1. Sponsorship application forms
2. applicant forms ie immigration forms( 'applicant' means person to be sponsored) - if u dont include applicant forms along with sponsorship forms,then ur forms will return to u frm CPC-M
3.all the required fee including applicant fee and Right of permanent res fee.
4. an upfront medical report whch u get from the hospital side after the medical ( u can do medical at any time, but suggest u to do the medical just before sending the forms to CPC-M, coz, in case, if ur process is delayed, u can avoid the early expiry of the medical while the process in on)
5. PCC ( right now i suggest u to send the indian PCC which u have now in hand, dont wait for south african PCC. at the same time u can write a letter to CIC describing ur situation regarding the south african PCC and include this along with ur application, also u can add the file number or any other proof which shows that u hav already filed for SA PCC, this will help u to submit the SA PCC when they ask for ur passport once the file is in NDVO) .my wife had similar issue, we described our situation well and gave proof also regardg the processing of foreign PCC.NDVO accepted that and they asked for the foreign PCC at the time of PPR. By the time foreign PCC was ready with us.aftr this it took hardly a month to get the visa
6. all other supportg documents, pictures etc etc.

i think u cannot sponsor ur wife when u hav already applied for sponsoring ur bro. either u can cancel the undertaking, if aproved, and start a new undertakg for ur spouse..but i dont knw for spouse sponsorship matter if there is any other rule is going on at present..same time it depends upon ur income as well.
i suggest u to call the CIC toll free numb if u r in canada now and u can enquire about it. they will help u.u have to have application file numb, PR card numb and al those thgs while calling them for identity purpose. also should have patience till u get an agent on line

But under provincial nominee program i am not responsible for financially supporting my brother. it is under just a scheme which was launched for certain provinces.
