I read your post earlier too and I feel so sad even now....
Unfortunately in NDVO's eyes this case somehow is not really convincing...

Just because there is a difference in education between PA and sponsor or a person is from a particular region where there had been some fradulent cases shoudn't impact other cases sharing similar scenarios but whose relation is absolutely genuine.

I wonder how can they bluntly deny a visa just because they didn't "FEEL" the relation is genuine even after enough proofs are given.

When we are required to prove how genuine a relation is to obtain a visa, even they shud be equally responsible to prove that a relation is fraud before denying someone a visa.

In such cases where they cannot prove that a relation is fraud, I wish as a benefit of doubt, they shud give visa.

I assume you guys must have already been consulting a lawyer all these days. They definitely should be in a position to provide a legal way of dealing this.

In the interview they emphasized that PA is bachelor degree holder and sponsor is only high-school. Second PA is from Punjab while sponser was born and raised in Canada. To them marriage seemed staged. However, we have given proofs that she visit every year for couple of months and have also tried for issue and gone under some treatments but in vain. The reports were provided.

At this stage, may I ask if someone can share their opinions or experiences?

Wow thats so quick processing for your bro-in-law . So lucky of him. congrats to him for that. :D i duno how long do we have to wait this :( sigh. Thats good. :) you will get good news before medicals expire. These matharchods only think about framing people. Like when does education matter in a marriage? So what if he his highschool pass and the lady has a bachelor's degree, this makes no sense. I think you should apply for an appeal and seek help of a good immigration lawyer with a lot of appeal wins.
 
Updated :). I know this wait is so frustrating. Just to get distracted from immigration I am working three jobs but still cant stop thinking about this haha. :) ;) :P

From my brother's file I couldn't understand one thing that he was interviewed and if VO has also made a determination about the outcome then it is out of normal procedure to do further reviewing. I think it's good for us that they haven't completely made determination just based on the interview but also doing further investigation. When the file came to ND it was recommended for double interview which i never head. Anybody else in the group knows about it?

You cannot apply for a TRV while your Spousal Visa case is in process.
 
Yes, of course he can apply. Now whether TRVs are granted or not while spousal app is in progress is a different thing.

When I applied for my wife's spousal visa, I called directly to CIC and had a nice little (well, it was kinda long) chat about this same topic, and the conclusion was that once someone applies for a spousal visa he/she can no longer apply for a TRV. The lady on the phone told me directly that if I apply for a TRV they will just return my application. Just saying from experience, I was gonna do the same thing.

GMCS notes tell you where your file is, what they have completed on your file (background checks etc), if you are recommend for a interview etc etc and they take 30 days to get to you once you apply for them. Since your file was just forwarded to the visa office you should not apply for GMCS notes. Wait at least 6 months before applying, or if you do not get a passport request within a month or two, that's the best time to apply because you will actually get useful information then.
