Hi guys,

I need some advice on a topic. I am sponsoring my wife who is in India at the moment, we applied just recently in May 2014. Her visa office will be New Delhi. No AOR, no sponsorship approval yet.

My wife is being required by work to move to Switzerland for a year. We are debating whether this is a good idea at this moment. What do you think? As she would be notifying the CIC about her change in address (since a year's time is quite long), I'm telling her that we would be delaying our file just by asking CIC to change our address - not to mention adding risk to our file. Do you see any other issues with this? Is this a good and safe idea?

Or may be it is a good idea? Her file could be transferred to Europe where processing could be faster?

Only a "year"? I don't see an issue with that. The transfer of her file which could be good, is CIC's call.

Yes, its for a year on work permit in Switzerland apparently, for a new project. So, you think we will be okay? It would not raise any red flags to CIC?

What about a situation where she is in swiss and she gets PPR from New Delhi? And then an interview? Wouldn't that be a problem? How will she go?

And does it raise any suspicious red flags on the file? I keep telling her we have a clean file, let it be, but she has pressure from work...

First of all, I do not think this adds risk to your processing. She is travelling for a genuine reason and working internationally does not indicate any red flags in relationship status.

Technically, I think she cannot submit a change of address application as her application is not being processed in Canada and the regional office hasnt received her application yet. (http://www.cic.gc.ca/english/information/change-address.asp#outside)

Since you have not received AOR, you might not even have a file number or UCI no. which you need to quote for address change request.

Swiss applications are processed from the Paris office (http://www.cic.gc.ca/english/information/offices/apply-where.asp#s).

The time it takes to process in Paris is 7 months (http://www.cic.gc.ca/english/information/times/perm/fc-spouses.asp#europe), which is less than the 13 months it takes in New Delhi.

However, considering your case, it might take longer to process your file from Paris, since they might have to co-ordinate with New Delhi office for security and criminality checks.

In my opinion, she shall take the project and move to Switzerland.
Once you get your UCI no., call the CIC helpline from Canada and explain your case and they will guide you.

I believe, most likely your file will still be forwarded to New Delhi (since that is what you must have written on your forms).
After they transfer your file to New Delhi, send an email to New Delhi office to inform them about the change of address and situation. Clearly mention when her project is expected to complete.

In case they sent passport request, you will have to request them for some time as she cannot send passport from Switzerland. Many people make this kind of request and it is normal.

We applied through Argentina and 2 months later decided to travel through South America and eventually live in Ecuador. We have had no problems with our application. We left our mailing address as a friends in Argentina in case they decided to mail us (instead of email). By giving a mailing address in Argentina is eliminated the wait in mailing it to Ecuador which can sometimes up to two weeks. If possible try and leave the mailing address in the country which you have applied through. The only thing we were nervous about was if we were called for an interview we would need to fly back to Argentina. However, we know that our relationship is genuine and feel they would see it that way too...which would waive the need to for an interview. When I did my change of address through our file number on their website, it changed the same day online and I don't think delayed the application.

Yes, she has done her medicals already. So, if I understood you guys, she should be okay to move to Switzerland now. When we get AOR and UCI no., we should email New Delhi to inform them of her change in Residential address. Also change her address through file number in website (which I don't know how it looks as I have no AOR yet). If she receives PPR, she would then need to get back to New Delhi within the time that they give us to submit her passport (including some time that we request them for), and then wait in India.

Should I actually email New Delhi about the change in address and ask them to process where they see appropriate (India or France), or is changing through the website as ciatij is mentioning enough to trigger this thought in them?

there is no problem in changing address, Aor or no AOR wont matter. u mentioned u live in canada, call CIC and update your file.

as far as your wife case about moving is concerned, i think you should mention details about her timeline to france. like said here, canada will send your file to delhi and then to paris/france ( closest visa office) and depending on the timeline your provide, paris is much quicker than New delhi visa office.
if i was you, i would quote address change "after" when u two decide about moving to paris or not. in totality, it eases visa office everywhere as well.

CIC will not transfer the app to Paris. Her VO is new Delhi and that's where the app will go. You could request the app be transferred from New Delhi to Paris once she is actually in Switzerland but understand that doing so will result in significant delays. It will also greatly increase the risk of forms/documents being lost in the transfer process.

Thats what I keep telling my wife. There are forms and protocols for everything, but at the end of the day, things are done by humans physically. And when you touch the file with changes, the visa officer can simply say "oh this file is too complex for today, let me work on an easier one" and puts ours aside right? Not to mention the mailing delays, and with the constant coordination between New Delhi and Paris on our file, wouldn't there be inevitable delays?

What I get from all your helpful replies is that this is possible in theory - she could move to Swiss and our file may or may not be transferred to Paris, but we will incur delays in any case. May not raise red flags, but delays are unavoidable. Furthermore, come PPR time, she will have to figure out how to submit her passport and it won't be as easy as mailing it away.

Not quite.

The file will not be transferred to Paris. Moving to Switzerland is not an issue; it will not cause a delay in the processing, nor will it raise any red flags. The file will be processed as normal in New Delhi.

The issue will be submitting her passport, as New Delhi requests the passport very early on and holds it for several months and it is illegal to mail an Indian passport across the border. She would either need to risk mailing it or authorize someone to carry it to India and mail it to CIC, provide a New Delhi address for it to be mailed back to and have someone carry it back to Switzerland.
